Eva Air - Final Update

The final update, although I said I wouldn't...

EVA have agreed that they were in breach of contract as I said they were.

They confirmed that their internal systems had the correct rules but this is not accessible to the public and that they did not communicate these to me and a systems error was at fault.

They have offered me a full refund with no conditions attached.

They have also offered me 1000 miles for my card and a free upgrade when I rebook with them.

I have accepted their offer and they have kept me as a customer.

So, to all you doubters about my ability to see when a contract is in breach or not - it looks like you cannot see further than your bottle of Heineken in BKK!
