Marrige Visa, No Wp, What To Do

Hi,

Wonder if someone who knows about these things can give me some accurate wife.

I currently have a extension of stay based on marrige which expires 1st week of June, iv been working for a company for about 5 moniths and altough I was promised a WP they seem to have problems in getting me one!!! Anyway I spoke to the outside compnay accountants who deal with all salary, wp, visas etc last month and told them that the first week in May I will be needing the last 3 receipts to prove I have paid tax for the last 3 months which is a requriment for renewal, no problem they said email me first week in May, saw him last week and long story short even though they said they had they have not been paying tax for me because I dont have a WP.. this is not good as i need to renew my visa but dont have 400k in the bank , this is a nightmare as i dont wanna lose this visa status and have to go back to visa runs etc.. my questions are..

If they pay the tax on my behalf will i need to show a WP when i renew or are they just interested in seeing these tax last 3 reciepts

What are the chances that if the company say my MRS is working instead of me and pay the tax for her that they are actually believe this and not bring it up in the interviews that we both have to have, thinking about it who is gonna believe that my MRS who had our 2nd child 2 week ago is working and earning good money and I am not working!!

What other options do I have?

Finally what happens to this withholding tax for the last 5 months? Surely once the WP comes they dont give it to the tax man and say here is tax for 5 months when he didnt have a WP?

You could have got a tax ID and paid taxes without a WP but this is now already too late for you.

As for immigration, if you use the income route, though not on the list of required documents, they may ask you for the WP! Especially if it is the first time you use this method.

The way I see it the only option you have left now is to deposit 400K NOW and get a 60 days extension based on visit Thai wife.

Though this would still not be enough to season the deposit for three months as appears to be required now if you have used the deposit method before.

Using wife as income earner is no longer an option.

You have been and are working illegally and subject to arrest. You do not want anything to do with police at this point. Show of tax payments would prove this.

You may want to go back to using visas until you are legal for 3 months or able to get money in account.

Any consulate should be able to provide a single entry non immigrant O visa on basis of marriage certificate and copy of wife ID card. KL will provide multi entry if you can show 100k in Thai bank account along with above. That would cover up to 15 months and only require exit/entry every 90 days and if you meet requirements could be extended during last 30 days of any stay.

You need a work permit before you start working. What makes you believe that they will provide you with a work permit after 5 months?

Working without a work permit seriously jeaperdises your future in Thailand, as you run the risk to be deported.

I would cut my losses andtry to find a new job. As said, your wife's income is not relevant. You can get a 60 day extension and see if you can provide the documents after the extension, or get a new visa instead of an extension of stay.

Thanks for all the advice, just to confirm I am already on a marriage extension so I am looking to renew it, I also have a tax ID number from my previous 2 jobs so but maybe paying the tax without a WP is not so good an idea, is the 400k have to be in the bank for a period of time i heard it was 3 months are they strict on this or can I put it into my bank 2 weeks before, and would I be able to get a 12 month if i went to Laos.

I understand that I am working illegally but at the moment with jobs being scarce I have no alternative..

One more are your guys saying that it is no longer a combined total for family salary so the MRS earnings doesn't count anymore

Correct.

Income has to be your's only and also the bank account can no longer be a shared account, it also has to be in your name only.

I ran afoul of this combined account rule last year and was short of 5 days for the 3 months seasoning after changing the account into my name. Had to use the 60 days option to overcome the problem.

1. Only KL with 100k in bank is a sure bet for muli entry O visa for marriage - most will only want to issue single entry and you then extend your stay.

2. As you have had extension of stay they may want 3 months in bank account (different policy at different offices). Only first application is for sure to be 2.

3. They are very strict on the time period at most places.

Cheers again for the advice, its kind of buggin to lose my marriage status its a luxury i love to have, not only do i not have to leave the country it works towards a resident permit so i heard 3 consecutive marriage visas and you can apply i heard.. any confirmation lopburi?

Iv already had 2 60 day extensions the first was advice off the forum, the second was when i had the wrong paperwork for the original EOS and they felt sorry for me with a baby in toe, now have a second but surely cannot repeat the trick?

As said there is a lot more to PR than 3 years on extensions of stay to be allowed to apply. Tax payments for an income of about 80k per month are normally needed to stand much chance of approval. It is normally a long process but those working here and planning to stay long term would likely be worth the effort. Best to read up on the PR process.
