Hi

does anyone have any idea about claims procedure regarding the recent unrest, My staff seem to think only shops that were burnt can claim, my belief is that any business affected from the events can claim.

My business is not located in that area but many clients are, as my clients were closed that affected the income of my business greatly, this could lead to having to lay thai staff off.

Does anyone have any experience, or can anyone explain who can and who can not claim? Also I believe there are 2 funds, one is government and one is BMA, is this correct? are they separate from each other. My staff say they have contacted the BMA who told them we have to have a shop that was burned to be able to claim, and have to show a piture of the burned shop, this sounds too simplistic and I think my staff are not really trying.

Thanks.

ok, got another staff member to call and we can claim for losses, all our details have gone into a system now. The priority is quite rightly the business in that area, firstly the burnt ones, then the ones that have been closed. Following that people out of that area will be dealt with that have been affected. The pot is not limitless so we might not get all that we have lost but we can still claim and see what the outcome is, the fear is people losing their jobs because of losses.

Family member whose farang's business was burned has made a claim, and is due to receive 1 million baht "in about 2 weeks."

Please keep us posted on the outcome of both of these businesses as well as any others who go thru the process. If monies are received within 2 weeks, it would say a lot about government efficiency which we hear so much negative about

I've added a sub-title to the topic to make it clear what the subject is.

Do please keep us informed of your success / failure at getting the compensation rightly due.

Perhaps any shortfall in claims settlement could be resubmitted to the causation of the claim for final settlement of the claim :

well if I actually blamed PTP I would consider this, but since I put the blame squarely at the feet of the ineffective government I won't follow this action, now take your politics to a political thread.

So I got a different staff member to call them, at first they said we are not eligible, the staff member explained (as I had instructed her) that we are affected as we have many clients in that area that could not open, this caused us financial hardship and it is difficult to pay staff salaries and could lead to letting staff go. This truth was the one that made them say we are eligible, it is the concern about Thais losing their jobs. Anyway we are now in the system, we have the ability to prove our losses via our accounts and tax filings etc and we were told we should hear before the end of June. Another client of ours has a business at sala daeng, he has been told half his staffs salaries will be paid until october.

I will also point out that at this point we have not been asked to prove our losses

URGENT: BCCT MEMBERS - COMPENSATION CLAIMS

________________________________________

LETTER FROM JOINT FOREIGN CHAMBERS OF COMMERCE

Dear Presidents

During the unfortunate events of the past weeks many businesses suffered losses.

The government has assured us that foreign investments / businesses will be treated the same way as Thai businesses and will have the same right to claim compensation along the set rules by the government.

The Minister of Finance has approved a loan of 10 billion Baht through the SME bank. To be eligible to apply for this support the company has to be Thai owned. This is in line with the laws governing the SME Bank and this cannot be changed easily. Obviously foreign owned business whether the ownership is through the BOI, the Foreign Business Act or the Treaty of Amity are not eligible to apply for the SME support set aside by the Minister of Finance.

If you have Chamber Members who have suffered losses due to the prolonged demonstrations, they should try to negotiate with their banks. The government is in contact with the Thai Banker's Association looking into ways to support these businesses. At the SAME time we would urge your members to submit their claims via your Chambers to the JFCCT office indicating their company name, claim etc. The JFCCT will submit the claims as a coordinated group claim to the government in the expectation that the government will live up to their promise that foreign businesses will have the same rights for compensation and support as local businesses.

Please DISTRIBUTE this information URGENTLY to all of your chamber members to enable them to act swiftly. Please send all compensation claims to the JFCCT office no later than by Friday evening.

Thank you for your support

With best regards

Nandor von der Luehe

Chairman JFCCT

NOTE TO BCCT MEMBERS - please email your claim by 2 pm on Friday 4th June. She will then forward them to JFCCT by their Friday evening deadline.
