So i have been in Thailand for 18 months. Married to a Thai so came from the UK on non immigration o visa. After this ended i traveled to Laos to get my double entry tourist visa. I didn't extend it at all.

Yesterday i went to Laos again to get my SECOND tourist visa. After leaving the embassy i noticed a red remark stamp saying

'Remark . The holder of this passports travels in Thailand under a tourist visa several times which may result in the refusal of a visa in the future"

My taxi driver told me to get a new passport, I have only 3 pages left which will be full by the time i need to get a new visa. Some farang chap told me to lose it??? He said once i go to poi phet in 2/3 months they wont let me back into Thailand?? Why not as i have a double entry. He was drunk though and full of it ;)

What are my options as i really need to stay in Thailand. I have 2 small children that i take care of and my Thai wife is currently in the UK working and wont be back for a lot longer than 6 months.

Use the double entry as normal, and use the 30 day extensions, that will get you almost 6 months. Why not apply for a Non-immigrant "O" based on being the father of the children or being married?

I thought i couldn't get that unless i return to the UK which isn't possible now. I need to stay in Thailand for over 6 months from now.

If i apply for a new passport will my old visa be transfered to it?

If you are the father of those 2 children then you can get a yearly extension on their behalf even if your Thai wife is in UK

Where can i get the extension? Does it matter that my immi o ran out over 4 months ago? Now just started on my second tourist visa.

Thanks for your comment btw it's made me a bit more hopeful about things.

You can apply at any Consulate, no need to go back to the UK. In the region you may only receive a single entry, good for a 90 day entry. But, if you can show 100K Baht in the bank, you can get a one year Multi-entry Non-Immigrant "O" Visa issued at Kuala Lumpur, Malaysia. Or, as suggesed consider trying to get an "Extension of Stay" based on having children.

If you obtain a new passport, they don't transfer the visa itself, but will transfer the relevant information.

Thanks for the link LB.

I will take a look in the morning. However can i get a extension as i am now on a tourist visa and my one year imm o finished on the date 9/9/10 but of course i left the day b4 that date so i got an extra 90 days.

Sorry if im repeating myself but need to be sure about things.

You can get a 30 day extension on your Tourist Visa.

You can then get a 60 day extension to visit your kids if your name is on the Birth Certificate.

You can get a 12 month extension if you are the Legal Father. (This requires more than just having your name on the birth certificate)

2.18 In the case of a family

member of a Thai(applicable only to parents, spouse, child, adopted child or child

of his/her spouse):

Permission will be

granted for a period of

not more than 1 year at a time.

(5) In the case of a parent, one of parents must have an average annual income of not less than 40,000 baht per month or a money deposit of not less than 400,000 baht for expenses within a year.

Ahh seems like i can only get a 60 day extension then which wont be so bad as it will give me 8 months more from now.

So i just have to take my passport and kids birth certificate to chaeng wattana in bangkok just before i have to do my 90 day report?

Regarding transfering info to my new passport. Surely they wont transfer that red remark info??

Not sure what you mean by 90 day report, but you can go near the end of your permission to stay and apply for the extension, you won't lose any days. As I said, they won't transfer a visa, but the relevant information(permission to stay date, etc.) to your stay at the time will be transferred to the new passport, the red stamp wouldn't be part of that.

1. There will not be any red mark or visa transferred - only your current extension of stay is transferred along with notation of previous passport/visa.

2. You are unlikely to obtain a multi entry non immigrant O in KL as that is only issued to visa wife (not children) and she is not in Thailand.

3. You should be able to extend your final tourist entry for 60 days to visit children.

4. You will not have a problem using second visa entry at any border. Cross/return while visa still valid and receive the second 60 day entry (make sure visa is still valid).

Just like to update.

Went to Chaeng Wattana today to extend 60 days.

FAILED due to not taking me son with me. Had all the correct paper work.

Nevermind as i got the 30 days.

So anyone that needs 60 due to visiting children needs to take the child too.

(the funny thing is i took my daughter with me but couldnt find her birth certificate this morning, som num nah)

Just curious - would they know where his wife is?

You shouldn't have to be doing 90 day reports if on a TV or non extended O visa. Am I missing something?

Yeah sorry i meant visa run (ie go to arranyapratet). Im used to going every 90 days so hence my mistake whilst typing. Apoligies.
