Last week we went to one of our local Temples to collect our son who had been a young novice there for 10 days.

I parked the car in front of the accommodation block ( which used to be the local school and has been bought by the Temple) To one side of where I parked, was the old school flag pole, like you see at all Thai schools.

I gathered up all the gear and loaded the boot, closed the boot, and without moving, I turned to the left and "Waied" a parent of another young boy. As I turned the flag pole came crashing down and landed on the boot of the car. I actually felt the wind from it's fall and placed my hand on the poleas it came to rest on the boot.

If it had fallen seconds earlier it would have landed on my back as I had my head in the boot!!!!

However all safe and well.

My wife phoned the insurance company and they sent a man from Saraburi to Singburi to look at the damage.

The man advised us that the damage was approx 10,000 baht and the insurance company would pay half and the Temple would have to pay the other half as it was their flag pole that fell.

The Thai parents of the boys all agreed, one does not ask the Temple for money.So with much talking and phone calls to the office it was agreed that we would pay 3000 baht and the insurance company would pay the balance.

The acting Head Monk of the temple said that the insurance company could " sue " the Temple but would they would never win such a case in Thailand.

The reason my wife agreed to pay the 3000 baht up front was to get things moving and the car repaired as soon as possible and the repair shop says it could be 3/4 weeks!!

Interesting ...... the Monk said that the Temple has no insurance cover for public liability or damage to others and would not pay out for any damages.This is not a small Temple, Hundreds visit it daily, and up to 10 buses come from Bangkok every Saturday and Sunday. They have spent millions on this Temple over the last 14 years that I have been visiting it.

never heard before that the insured party has to assist if other parties are at fault , rather than the insurance company paying out to the claimant and then chasing the other party for some liability.

Interesting.

About 15 years ago I flew into Chang Mai for a visit with my wife. Early in the morning we hired a car a driver and went up to the Wat way up the hill that is very famous but I can't remember the name. When we arrived the road was full of blood and two cable cars were crashed onto the road. It was horrific. Look it up if you want to know more. If I am correct the head monk went to jail and negligence was a real thing no matter who you were. Talk to a lawyer because negligence is a crime against everyone!

OP, od insurance claim as normally your 1st class covers your car no matter what, and Insurance problem to get other party to pay to them. Often they choose to settle with other party rather than costs for a court case.
