Hi,

My girlfriend is pregnant and i need to bring her to the UK. Looking at UK visa info, i need to show that my previous marriage (to a UK citizen) has ended. However, i do not actually have the divorce finalised (and it may take a few months) but i would like to get my g/f over ASAP.

Anyone know if you need to have a Decree Absolut before applying or will a Decree Nisi (which i already have) be enough? I'm assuming i need to apply for a "married partner/fiance/unmarried partner"-type visa?

Any help gratefully/advise received.

If your g/f wishes to apply for an unmarried partner-type visa you don't need to show that you are free to marry. However, the rules governing this are quite stringent and as a minimum, you will have to establish with documentary evidence that you have been living together for at least 2 years in a relationship akin to marriage.

For a fiancé(e) visa, you will need to show your decree absolute as it is a requirement to be free to marry. However, your g/f could apply now, requesting an interview date for a time when you will be divorced.

One of the guys in our office had problems with this, he apealed and lost the apeal. Redux story is..

When he and his fiancee went to the Embassy the visa application was refused on the grounds that until his decree absolute was issued he could not demonstrate freedom to marry.

During the apeal it was also stated that until his decree absolute was issued he had no way of demonstrating his ability to support his Thai Fiancee as his income, savings etc were subject to a court ruling and the court had yet to rule.

Thanks for the info guys - even if it wasn't what i necessarily wanted to hear. however, makes sense that a decree absolut needs to be issued - so i'm going to kick my lazy, money-grabbing lawyer up the bum (this "amicable" divorce has taken over 2 years!) to make sure he pulls his finger out.

of course, it's too late for me to pull my, er, finger out
