Air passenger posts bail after being arrested for wearing saggy pants

SAN FRANCISCO, CALIFORNIA (BNO NEWS) -- The University of New Mexico football player who was arrested at San Francisco International Airport for wearing saggy pants has been released on bail, local media reported on Friday

Deshon Marman, 20, of San Francisco, allegedly resisted his arrest when police officers tried to handcuff him after he had been booted off Wednesday morning's US Airways Flight 488. He was removed from the Albuquerque, New Mexico-bound flight because he refused to pull up his saggy pants in order to cover up his underwear.

Police Sargent Michael Rodriguez told the San Francisco Examiner that, after refusing to pull up his pants before boarding, he went on to pull them all the way down after taking his seat.

The aircraft's captain put Marman under citizen's arrest for trespassing after he refused to exit the plane as he had been ordered by the captain. When police escorted him off the plane, one officer reportedly cut his hand and sprained his knee when Marman resisted arrest.

Marman was released from the San Mateo County jail after paying an $11,000 bail, although the county's District Attorney's Office has not yet filed formal charges. Prosecutors have until July 16 to decide whether or not to file charges of a felony count of battery of a police officer and misdemeanor counts of resisting arrest and trespassing.

Andrew Christie, a spokesman for US Airways, acknowledged to the San Francisco Examiner that the airline does not have a specific dress code, but underlined that they ask customers to "dress in an appropriate manner to ensure the safety and comfort of all of our passengers."

Controversy has emerged since the incident. Defense attorney Joe O'Sullivan described the situation as racist, saying US Airways would "pay greatly for that fact." Meanwhile, American Civil Liberties Union of Northern California attorney Michael Risher said the airline was exposing itself to possible accusations of discriminatory practices since it does not have an established dress code.

Missing from the above;

- US Airways flight attendant him to pull up his pants as his underwear was at his knees. His buttocks and genitalia were visible beneath his pants and the FA was concerned for the comfort of other passengers.

- DeShon Marman refused.

-Another employee asked him to comply and he refused and was reportedly rude quoted as saying he didn't have to.

- He was asked again and said no.

- He was asked to disembark and refused.

- The police were called to assist in deplaning him and he was not cooperative getting into a physical altercation with the police.

Despite the accused mother's statement that he was arrested for being a big black man with dreadlocks, I think it has more to do with the fact that people do not want to sit next to some rude guy with his pants hanging down. And the next passenger to occupy the seat will most likely freak knowing that this guy's ass juices seeped out of the thin polyester blend underwear onto the seat cushion.

He was actually arrested for being a big, rude, black guy with an attitude who would not follow instructions.

Add...whose underwear was showing along with his butt crack. Reason enough to be kicked off! IMHO...

Er, I am having difficulty trying to visualise the fahion statement that the young man was making. How do you walk, if the underwear is at the knees? And if genitals and buttocks were visible beneath his pants, does this mean the cloth of his pants was just too thin?

Wonder how plumbers manage to fly. ;)

According to contemporary fashion rules, the butt crack is only allowed to show when you bend over--so most plumbers would be OK.

My question is did the TSA give him a pat-down and does anybody have a video of it?

Plumbers are allowed to fly as long as they bring along their butt crack filler! Not a pretty sight for sure. :(

So, he was arrested for looking, and later acting like, a douche...

Claiming he was arrested because he was black is just ridiculous. I am sure there were other black people on that plane who were not asked to GTFO.

edit: Wait, what? His name is DeShon? Poor guy...No wonder he feels victimized.

And on the same day we were treated to stories of a family from England that started a brawl on a plane to Barbados and another Ryanair passenger mouthing off. I give thanks that I don't see or experience this in Thailand. Honestly, I have never heard or seen of this on a TG, Nok or Air Asia flight I have been on and I travel on some of the busiest holiday goer routes. For that, I say thank you Thai visitors and Thai people. Now if only I could get people in my row not to ever take out their dentures or go for a good nose pick or not encroach on my space, I'd be thrilled. Which brings another good point up about Thais: They fit in their seats and don't ooze out of it like many farangs.

And to correct my previous post it wasn't hs undies but his pants down low. Me bad.

Probably try to argue "freedom of expression" excuse. I taught at a black high school and it was a daily battle over saggin'. Fashion comes from prison, where sagging your pants low shows you are so tough that you dare anyone to try to make you their boy toy, if you didn't know. More insane than those tight skirts women used to wear and then could barely walk.

More power to the airline for kicking him off.

Plane etiquette and antisocial behaviour is a growing problem on planes. Matched by the growing obesity of many passengers. A planeload of Filipinos is good fun, a planeload of Arabs is sheer hell. Just my personal experiences.

Fashion?

Several years back an organisation I worked for had a university student in to work in the front office one day per week; a suit-and-tie standard for male staff and students expected to dress tidy; one week our (male) student decided to push boundaries/make a statement . . . arrived in jeans showing about 4-6" of his boxer shorts. Worth watching from the sidelines . . . took about a minute for the woman office manager to get him in her sights, and explain in very simple language that it he turned up like that again she would kick his boxered arse down the six flights of stairs to street level.

Almost had pity for him as he had to spend the rest of the day in her company.

Looks like he will become part of the problem and not part of the solution for the woes of the USA economy and work ethicsad.gif

Women are subject to rules about what they can wear on planes as well. Sometime back there was a lady who decided to wear her bathing suit. It was not allowed. Unfortunately, I don't remember where this happened, so I don't have a link to it.

I think there are two different issues in this thread. First is the situation with TSA and the 2nd is actually being on the plane. I routinely go through security wearing only shorts and a T-shirt. I don't even have socks on--only flip-flops. The clothes that I will wear on the plane are in my carry-on. I can get through easily and quickly. No taking off watches, belts, shoes etc.

TSA is only concerned about security. The personnel on the aircraft are concerned about several other factors, including passenger comfort.

Racist.

If a chick had her arse hanging out would she be arrested ??

Uh, to make your comparison work, that would be "Sexist."

But I'm generally a 'logicist', and judge people mercilessly on their logic.

FWIW, there is a relatively recent TSA Directive which says, (paraphrasing here) that you must obey all crew-member instructions. Assuming the instructions are reasonable it may be best to just do what they ask? This incident seems to have started off relatively innocuously, and then escalated from there.

Interesting timing. Just aired a fashion show on Thai TV showing the latest Men's jeans fashion. Comment they made is "baggy pants and showing your boxers" is out of date! So is the tee shirt under a sports jacket and several other modes of dress. They slowly went from the New hip hop trends to business suits. Showing what's in and whats out!

Now they also determine how we should be clothed, just because some a..hole might be offended by the way some-one else is clothed.

Ridiculous !!

What's next, we should also have our hair groomed in a certain way ?

So, then, it's OK to appear in a public place in your underwear, with your bits visible? Congressmen have been forced to quit for less...

Let's allow ALL nor-injurious, or, better all non-physically injurious behavior in all public places, and also in private places, which applies to aircraft, owned by a corporation, on which you travel by their consent. Then we can all flip each other the finger, curse (see recent train incident), and do whatever we dam_n well please, and anyone who objects is an a..hole?

Is that what you mean?

If your hair style blocks my view of the movie screen, YES!
