Leasing Contract Land And Divorce What Could Happen Please ?

Featured Replies

Hello,

I’m married with a thai woman and i did a leasing contract with her for a land i paid before, i get married and on this land i build a house and put it on my name. In case of divorce what happen to the leasing contract and to the land and house please ? We leave together there for now...

Thanks :)

If you leased land before getting married, your land lease should be safely yours alone.

If you applied for a buildinpermit, build a house and had Tabien Baan issued while married, it belongs 50% to you, 50% to your wife, if you divorce.

If she is registered as 1st resident (master of House) in Tabien Baan, she remains living there and decides who can live there, until you have come to an agreement, which in court can take +5 years

Thanks a lot for your answer, yes i have a Tabien ban on my name because i applied myself for a buidind permit, so if the land it's to me and we have to share the house 50%/50% so can't sell the house and i can't live inside, what can i do to not loose all my investment ?

Thanks :)

what can i do to not loose all my investment ?

depending on the value of the land and house, i would put it into a company formation,

there was that topic before about the farmer that has put me right off leasing land off a thai partner...

IMHO , better not to have anything in her name, or lease from her ect... esp if you have doubts by making this post

EDIT

Also, what ever you decide to do, get it all check out by lawyer that is independent .... , not some local Thai lawyer that might know your future wife, plenty of sponsers on TV to chose from, might cost you a few more quid now, but could save you a fortune in the future
