TRCT chief urges leniency for lese majeste cases

Harsh enforcement of Article 112 could hurt monarchy, Kanit says

Kanit na Nakhon, chairman of the Truth for Reconciliation Commission of Thailand, has called for judges to treat lese majeste offenders more leniently amid mounting revulsion against the "harsh" punishment meted out in recent cases.

"For certain offences, although there are affected parties, the judicial process does not have to take action at all - especially if the affected parties are public figures," Kanit said in a recent exclusive interview with The Nation.

Judges should show mercy and suspend jail terms rather than impose penalties strictly in line with Article 112 of the Criminal Code, he said.

Invoking Article 112 too severely could backfire on the monarchy, especially now that certain groups in society are campaigning for the repeal of the article, which they said was being used as a tool by the powers-that-be against opponents, he said.

Kanit said he is writing an article about his stance towards Article 112 that he is certain would draw criticism when it is published.

As examples of clemency, he cited the decisions by former commerce minister Uthai Pimchaichon and former prime minister Prem Tinsulanonda not to take action after they were physically assaulted.

Uthai was attacked with a bag of excrement but did not press charges, while Prem was hit by a Ramkhamhaeng University student, but allowed the student to go home scot-free, he said.

Had police taken legal action against the two attackers, Uthai and Prem might have suffered a negative image, he said.

"These incidents may be applied to the case of the monarchy," he said.

Although Article 112 prescribes the maximum jail terms, judges do not have to hand down sentences for imprisonment, he said.

Jintana Kaewkhao, an environmentalist, was another case where the principle of clemency should have been applied, he said.

Jintana served 59 days of a four-month prison sentence after she was convicted of participating in a violent protest against a power-plant project, but the judge should have completely suspended the jail term because it did not bode well for either side, he said.

In its latest report, the TRCT claimed that the main cause of the current political conflict was the violation of the rule of law related to the Constitution Court's ruling in the first asset-concealment case against then prime minister Thaksin Shinawatra. The court ruled in favour of Thaksin, saying he did not intend to conceal his shares.

Kanit said the Constitution Court erred when it counted the opinions of the two judges who declined to rule on the concealment charge as votes for acquittal, along with the votes of the six judges who ruled that Thaksin was not guilty. Thaksin was acquitted by a majority of eight votes.

The two judges violated legal principles by declining to consider and rule on whether Thaksin had concealed his shares. Worse still, the votes of the two judges were counted as acquittal votes for Thaksin, he said.

Had the Constitution Court followed the law, Thaksin would not have become as big an issue in Thai politics as he has, Kanit said.

Kanit said he did not fear that the TRCT's report related to Thaksin's asset-concealment case would stir up criticism against the TRCT and lead to the rejection of its proposals.

"The question of whether the TRCT's study will fail will have to be answered by society and the media," Kanit said.

"We have presented an academic view. We simply presented the fact that the court did not abide by the law in Thaksin's case."

Girl stabbed; KOs attacker

The Nation

A Lampang schoolgirl yesterday was chased by two men on a motorcycle who were after her gold necklace, but she managed to knock one of them out with her helmet while the other one stabbed her repeatedly before fleeing.

Phawinee Inthiya, 17, a twelfth grader at the prestigious Lampang Kalyanee School, was under intensive hospital care for five knife wounds, including one on her left breast.

Komol Khunmee was under police detention pending questioning after initial treatment for cuts to his lip and the loss of several teeth caused by the girl's helmet.

According to her police statement, Komol and the other suspect on the run followed her motorbike and kicked it over, before Komol approached her and snatched her necklace.

She hit him in the face several times with her helmet, while taking the stabs in a fight, before he fell down unconscious and the other suspect escaped on foot.

They left behind a blackandred Honda Wave without a licence plate at the scene, a road in Muang district.

Siamtech, agencies offer aid to Thon Buri

Siam Institute of Technology (Siamtech) and its partners from various agencies have recently started a social enterprise to provide rehabilitation assistance to people on the floodhit Thon Buri side of Bangkok.

Assistant Professor Jomphong Mongkhonvanit, director of Siamtech, said the relief enterprise had four departments for repair; services and recreation; production; and public relations.

It has recruited the institute's teachers and students and interested people to perform various rehabilitation jobs depending on their interest and ability since November 18.

The repair department helps clean up and fix flooded electrical appliances and motorcycles. The services and recreation department distributes relief kits and other necessities to flood victims and entertains them.

The production department helps seek materials and produces items needed during floods. The public relations department makes the activities known to the public and seeks people's participation and donations.

The enterprise has produced a TV show, videos and handbooks providing useful information about car checks and repairs for car owners with problems caused by floods.

The Thai Red Cross Society, the Phasi Charoen and Bangkok Yai district offices, Foundation for a Clean and Transparent Thailand and the Army have also given a hand to this assistance project.

Budding Thai Edisons shine in South Korea

Inventions by Thai vocational students bagged three silver and two bronze medals at an international competition in South Korea early this month.

All five Thai teams scored prizes at the Seoul International Invention Fair, Chaipreuk Sereerak, secretarygeneral of the Vocational Education Commission, said recently.

Exercise Equipment, Adjustable Seat and Foot Support by Detudom Technical College, Utility Chair by Samutsakhon Technical College and Necktie Bags by Siphraya Polytechnic College won silver medals.

The bronze medals went to the Portable Stove of Hat Yai Technical College and Preserved Fruit Machine of Phitsanulok Vocational College.

Her Royal Highness Princess Chulabhorn Valayalaksana met the students to see their inventions showcased at the fair, which was held by the Korea Invention Promotion Association.

The Vocational Education Commission and the National Research Council have worked together to promote vocational teachers and students to become researchers. They have provided them training and funded them to practise doing research and create inventions since 2009.

Sonthi warns charter amendments may disrupt reconciliation process

Pheu Thai Party should not rush to amend the Constitution for fear that the on-going efforts to bring about reconciliation would be jeopardised.

Sonthi, the chairman of the House special panel studying how to create national reconciliation, said charter amendments are sensitive issue and it might not be the right timing to carry out them now.

"I think they should think it over. They must listen to the voices of the majority people because the ordinary people would like to see reconciliation happen," Sonthi said.

"If the government does something for just one person and if the people can be united with a common case, there may be an uprising t the level that the authorities cannot fight back."

Pheu Thai Party Insists to Reform Constitution

The Pheu Thai Party spokesperson insists to reform the constitution and will use the 1997 constitution as a model.

Pheu Thai Spokesperson Prompong Nopparit affirmed that the Pheu Thai Party is looking forward to make a constitution amendment to follow, as they promised to their supporters during the election campaign.

The issue will be discussed and concluded during the Pheu Thai Party's conference by tomorrow.

The constitutional amendment will be sanctioned by the Elected Constituent Assembly, and they will use the 1997 constitutional amendment as a model.

Whether or not an independent committee will chair the constitutional amendment is debatable, as it depends Ukrit Mongkolnavin, who is the chairman of an independent committee on the rule of law.

The government and the Pheu Thai party will not interfere in the process.

Furthermore, the spokesperson insisted to launch a public hearing as well.

The spokesperson claimed that some politicians have rallied to oppose the constitutional amendment and to topple the government because they are afraid of losing their power.

Insurgent killed, one surrenders, in clash with government force

NARATHIWAT, Dec 19 - One presumed insurgent was killed, while another surrendered during a gunfight with a combined force of police and army personnel in this restive southern province on Monday.

The government force raided targeted areas in Ruso district Monday early morning after suspecting that members of the insurgent group Runda Kumpulan Kecil (RKK) were hiding there, preparing to launch violent attacks.

As the authorities searched for irregularities at a house, they were fired on by the insurgents. The government force countered the attack and a shootout lasted about ten minutes, ending when an insurgent identified later as Abdulromae Ha-rae, 31, called out his surrender.

The dead body of another insurgent was found at the scene, and was identified as Ruslan Maneng, 30. An AK-47 assault rifle and cartridges were also found near his body.

Security personnel searched another house and found explosive devices and other traces of RKK members having stayed there, but they had left the building before the authorities arrived. (MCOT online news)

Thailand Sees Bt 60 Billion Inflow from Flood Insurance Claims

Thailand saw a huge inflow of two billion US dollars, the equivalent of 60 billion baht last week, while the central bank said the fund's surge will not cause the baht to strengthen as its impact will likely be offset by a large outflow due to overseas investment by Thai investors and the withdrawal of funds by foreign investors.

Bank of Thailand Governor Prasarn Trairatworakul said the country is seeing a surge of capital inflow, as around 60 billion baht in insurance claims related to this year's flooding flowed into the market last week.

However, Prasarn said the capital inflow surge will not cause the baht's value to strengthen too much, as there was also significant outflow due to the withdrawal of funds by foreign investors who were concerned about the debt crisis in Europe and inclined to sell assets in immature markets and hold more US dollars.

Prasarn added that Thai companies were allowed to keep insurance claims or funds in Foreign Currency Deposit accounts.

These accounts have no deposit limit and will help companies if they repair and purchase of machinery in foreign currencies.

Thai composite stocks index (SET) at midday Monday stood at 1,037.81,up 3.75 points ,0.36 per cent amid light trade of Bt9.65 billion turnover.

Blue chip SET-50 index was at 729.41, up 2.92 points, or 0.40 per cent.
