Accident - Not Responsible - 10 days to Repair - No Spare Care Provided - Acceptable ? Should I get a spare car from garage or insurance ? How to force them ?

Hi,

I have been hit by another car, this driver is 100% guilty (my car was parked!), garage needs 10 days to repair but doesn't want to let me use a spare car and insurance doesn't mind.

I'm ready to make big problems to all of them to get a free car to use during these 10 days, can you help me to argue ?

I've had the same issue and was not given the use of a spare vehicle. Thats because the use of a loaner was not covered by my insurance.

I'm told there are a couple of insurance companies (I don't know which) that allow you take out an additional clause so that in the event of an accident you have use of a spare vehicle. However, it is not the norm for regular first class insurance to provide this.

Don't see it's the garages job to provide a loaner, unless he's going to be reimbursed by ins co., he's only repairing the car. Surely it's the insurance company's responsibility if covered. Are you claiming on your insurance, or the perpetrators ? If his then check his conditions. As richard_smith237says not normally covered here.

A driver hitting a parked car does not have to be 100% guilty, depends on where the car was parked, road markings, position on road, light on if dark etc. Not saying hes not fully culpable in your case.

No garage will provide a loaner. I've never seen that here or in the west. It's the responsibility of your insurance company, IF you have that clause in your coverage. If not, then you are not entitled to a loaner car.

Have to agree with th the others...

This is based upon your insurance policy..If both cars have first class insruance, then the Thai systems is "no fault". This means that your insurance will pay for your repairs. So if your policy does not include a free rental car... then no rental car.
