Ok, daughter came to visit for 30 days, and heads back home next week. (she's here on 30 day visa-on-arrival, ends the day she goes back)

While here, ex went looking overseas for jobs and found one, we discussed daughter coming back in Sep/October timeframe to live with me, so I started researching, and determined that I needed to have my daughter do the process for an ED visa (which is what I'm on now, switching to Married-O soon) using a bilingual school in Rayong. Was planning on daughter going back home next week, and doing the process at Thai embassy there (Tokyo) for the ED visa.

Just got an email from ex (after immigration closed for the weekend) that her job starts sooner than she thought, and would like my daughter to come back prior to end of August, or just stay with me now (to save on cost of ticket back)

So, questions I have:

1) can I extend her visa here (with no plane ticket going back, as the return flight is non-movable/non-refundable)?

2) can I get her an ED visa while in country, or do I have to do a border run with her?

My wife is Thai, and I am here on an ED visa good thru end of November, and was planning on starting the process to change to Married-O visa when my daughter went back home next week.

I am in my wife's housebook (yellow), and have requisite amout of money in the bank for married or retired visa (but not yet 50)

Does this sound doable to anyone? Want to have my daughter stay here, and do the process for the ED visa for her, but don't know if that is possible. If necessary, no problem going to do a border run with her (as that would be cheaper than flight back to Thai in August, and it keeps her here!), but want to know if I have to extend her current visa or not (as she is 10, and have read no penalty for overstay for children, but need the ED visa to get her into the school)

If anyone has some experience/advice, that would be great!

I guess the daughter is with the ex wife and now are marreid to a Thai national. As your daughter, she can stay with you and your Thai wife as a dependent of you and your wife till she turns 20.

She would need a new visa, an ED-visa if she goes to school or a non-O visa to be a dependent of you and your Thai wife. Given the time frame there is no time to convert.

The simplest option is to just let her stay till she returns, as there is no overstay fine for children under the age of 15. This will probably be what immigration will advise you.

Actually, she is here with me now.

We havejoint custody, with my ex retaining majority of physical custody, however, she wants her to come live with me while she explores employment in Europe.

So, do i understand:

no overstay fee?

and

can get her an ED visa with her in Thailand? (even if she is on overstay?)

As Mario2008 says just let her stay, no overstay payment will be due, also an ED Visa is not required just to go to school here. It is only needed if studying is the basis for staying in Thailand.

For short time the overstay is no problem. First sort out your own permission to stay to based on having a Thai wife, that will take a few months. When that is settled, go abroad with your daughter (don't forget a re-entry permit for yourself) and apply for a non-O visa for her, and 60 days later an extension of stay for her at immigration based on being a family member of a Thai, or with papers from the school an ED-visa.

If you are planning on getting an extension based upon marriage. You should make a trip with her to one of the nearby consulates and get a single entry non-o visa for her to visit you prior to applying for her an extension based her being your dependent. The paperwork would be a lot less than going the ED route.

Mario2008 my 16 year old daughter is coming out to stay with me so am I reading it right that she can get a visa to stay with me and my wife (Thai), as a dependant untill she is 20?

ahhh, will check with school, as their site says they want an ED visa for foreign students:

Admission Requirements:

Original completed Application Form Current school year report or transcript

A photocopy of birth certificate / valid passport / student visa (Non-Im ED)

Two (2) recent color photos 1.5 inch or 2 inches of applicant

A photocopy of the household registration (for student -Thai citizen only)

Certification of personal name change (student/ father/ mother/ guardian)

Copies of parents’ Thai ID card or foreign passports and visas

Understand overstay not an issue, but to get her into the school... I'm betting the ED visa is a requirement.

So, is it possible to get an ED visa without doing a border run?

I read it as that 2.18 allows the child of a spouse to apply for a 1 year extension of stay based on being a family member of a Thai national.

alright, so for me: Chiang Mai immigration says I need to leave the country (recommended Laos) to get the non-imm O married visa.

For daughter, can do ED visa there as well... waiting for paperwork from school to be complete. (no problem with the overstay)

However, school also says the dependent stay would work as well. When my wife asked at Chiang Mai, they said she would have to adopt??? to get that type of extension. From what I read here though, that is not the case... anyone with experience? Where they went?

Also, any other suggestions on where to go to do the border run? Have car will travel...!

You are the one that has to apply for your daughters extension at the same time you apply for your extension. Adoption is not required. Links to police order follow see 2.18.

I think you are asking about a visa run not a border run. The nearest Thai consulate would be Vientiane Laos across the Mekong from Nong Kai.

She does not have to get an ED visa a non immigrant O would also be good for the ED extension. You only need her birth certificate since you will have the paperwork to get your non O that includes your marriage certificate, wife's house book and ID card and copies of them.
