Ok sorry about titel,dont know how to frase it but her we go.

I like to set up a company and get a WP. This is how I think its done but please correct all my errors.

1. Get a Co.Ltd set up

2. Go to labour office with company papers and fill in application for WP.They will give me a recipe that I applyed.

Doesnt mean I will get the wp.

3. Go to embassy and bring all this different company papers and the recipe from labouroffice and get my B-visa.

4. Get back to Labour office with my B-visa and give them the last papers they need.Now I have to wait for them to approve.

Ok my worries is that I setting up a Co.Ltd and then they will not give wp for some reason.Then I just used a lot of money on company and visa that I dont need. Is there any way to get some indication before start all of this? Or is it take a chance?

If there were clear rules no problem but like all goverment offices it up to the officer at that time that can decide yes or no.

Tell me that Im wrong.

There are clear and unambiguous rules about the types of job that are not allowed for foreigners. In other words, it is very much a question of the employer's business activities, as outlined in the company's articles of association, and your job description and your qualifications for the job. I assume you will use the services of an experienced law firm to set up your company and they should know how to word these documents and handle your work permit application.

And the requirement that the firm is Thai owned and staffed to 4 Thai for one work permit issue? And that for at least the first year you will not be able to extend your stay so 90 day visa runs will be required.

I agree with all the above comments, however I wouldn't rush to use a law firm. Their charges are often outrageous for very little work.

- It is true you need someone who understands how to set up the company so that a WP can be obtained

- The paperwork to do all of this (company set up and WP application) is very straight forward.

There are numerous business agencies who are fully familiar with the laws and the processes and charge half of what a lawyer will charge you.

If your in the Pattaya area please PM to me and I will privately give you the name of a very professional Thai lady who owns a highly credible well established accounting firm.

She handles all of the above, speaks perfect English, good listener, very thorough and very pleasant, and her charges are very reasonable.

She also handles all the annual returns (Thai companies office, Thai taxation office, etc) which you need to submit every 12 months, again very thorough, and very reasonable fees.

If you plan on opening a business anywhere in the world you should use a lawyer. If you cannot afford one then you should not be opening a business. Don't forget you need a company stamp and also your Thai partner will get 50%, you will get 49% and you can use your lawyers firm as the remaining 1% SAFETY

Well thanks guys,didnt know about the 90day visa trip,I will work in SEO and online marketing and all in Scandinavian countrys so I sure I dont do work that Thais can do.Hire 4 Thais is no problem,I will hire more than that.Thanks for all advice about lawyers etc.It is always good to be safe.Actualy i was thinking to go and talk with the labour office before I start set up company and get a feeling of there opinon. I should be ok in this line of work,no Thaiworkers can do it but I will train them to assist me.

What a silly comment! Why do you need to waste money when setting up a business anywhere in the world - surely it's more important to learn local business rules and regulations before starting out - then you can set it up very easily yourself - incidentally the application forms are all in Thai and come complete with ALL documents that you will require. Last time it cost me 500 baht and the company registration officer completed the documents for me. If your business (a Limited Partnership is a good bet) requires only two partners Thai 51% Foreign 49% and paid up capital (with bank proof of importing the money from overseas of (and this depends on area) 2,100,000 Thai Baht for one work permit (usually around 3,5 million for two). Depending on area you will require 4-5 Thai workers (with ID card proof). Your business type must fall into a non- regulated category and will will need to produce written evidence of your education and experience relating to that type of business (usually a letter from a Western company will suffice. You will also require a non-imm "b" class visa. After your work permit has been issued you tale it to the immigration service who (in addition to the company registration and other documents that you used to apply for your business registration) will require both a tax and VAT registration before they issue you with a 12 month visa. (once you apply to the immigration service your temporary stay in the Kingdom will be extended at each visit so, giving you time to produce any other documents and proof they may require). Remember that foreigners (except teachers) have to pay tax each year based on a minimum salary per month whether or not you actually manage to raise that amount of money within your business (it varies with country of origin but on average is about 55,000 per month).

That's the legal way to go however, and especially if you live in Pattaya,, give a corrupt lawyer about 25,000 baht and he will fix you up with what really is an officially sponsored unlawful business
