I seriously doubt he will show up for the Trial...but they should give him amensty long enough to come here and slap the cuffs on him

and throw his sorry butt in the monkey house. Making clean toilets would be a fitting job.

Leave Thai politics to the Thais and enjoy your life here while you can. Life is too short. The average Thai, no matter the shirt color, are great people who basically let you do what you want as long as it is legal. Try taking a trip to farming villages and appreciate the hard work they do in the fields this time of year.

Probably the best and wisest post on this forum for months. All these ignorant idiots on here who come from countries where the politicians are whiter than white! i don't think so. It amazes me that people on here are so quick to slag off Thailand, when the countries they come from are probably worse! They don't realise how stupid they look. All the "experts" who as soon as a story about Thai politics comes up are straight on the computer desperate to show how ignorant they are. Laugh Out Loud.

Thaksin faces trial over KTB loan to real-estate firm

KESINEE TANGKHIO

THE NATION

BANGKOK: -- The Supreme Court yesterday agreed to try ousted prime minister Thaksin Shinawatra for alleged criminal malfeasance involving bank loans to a real estate developer classified as a non-performing debtor.

Thaksin and 26 others were accused of conspiring with executives from state-run Krung Thai Bank to approve Bt9.9 billion in loans to Krisada Mahanakorn, a major real estate company, and its subsidiaries.

The court's Criminal Division for Holders of Political Positions has scheduled the first hearing at 9.30am on October 11.

Winai Damrongmongkolkul, spokesman for the Office of the Attorney-General, said the Office would deliver summonses to all 27 defendants. Although Thaksin is living in self-imposed exile, his legal domicile is still in Thailand, so his summons will be sent to his home address here.

The prosecution will work on the case based on evidence from the National Anti-Corruption Commission (NACC), he said.

Thaksin and his alleged accomplices - including bankers, the debtor companies and their management - were charged with jointly committing offences through their involvement in extending credit that failed to meet lending criteria and caused damage to the economy.

After the 2006 coup, the government formed the Asset Examination Committee to look into alleged graft violations involving Thaksin, including a complaint filed by the Bank of Thailand against Krung Thai Bank over three dubious transactions.

The AEC's mandate expired before the case reached the trial stage. But the National Anti-Corruption Commission picked up on the AEC probe and ruled that it suspected foul play.

In June 2008, the NACC submitted the case for prosecution. A panel of state attorneys and graft-busters was set up to collect more evidence and build a stronger case. The Office of the Attorney-General in June decided to seek a court indictment with the central claim that then prime minister Thaksin abused his office to pressure the bank into granting loans to Krisada Mahanakorn despite the company's poor credit rating.

To skirt the company's bad credit standing, loans were allegedly arranged for proxy companies to channel the funds to Krisada Mahanakorn. The transactions turned into non-performing loans.

The defendants can be divided into three groups - Thaksin, as a political officeholder exerting influence over the loan process; Viroj Nualkhair, then managing director of the bank and the bank's board of directors; and three companies, including Krisada Mahanakorn.

The prosecution contends that the doubtful loans were acts of corruption due to the losses inflicted on the state-run bank.

The case will focus on three transactions, including a Bt500-million loan to RK Professional Co and a Bt8-billion credit line to Golden Technology Industrial Park, which also received a Bt500-million loan to acquire the land and Bt1.4-billion loan to develop the project.

The last transaction was financing for a Bt1-billion purchase of convertible preferred shares from Krisada Mahanakorn by Grand Computer Communication. All these transactions took place during Thaksin's time as prime minister.

I wonder how the Dubai authorities will look at this.

I can't see his sister or brother in law starting the extradition processes. No conflict of interest there for sure.

Who cares? Nothing will happen. It never does. Thaksin will come home soon, the army will roll out again, another party will be banned and replaced with the same mob just like a financial services company going strategically bankrupt every few years. Yingluck will make her billions and so will her friends and just as the democrats are feeling the financial pinch, the Army will rescue them with a nice coup and give them a few years to rape thailand of its last Baht.

Mean while, on every street corner, there is horrendous poverty on display. So who cares about these crooks. Thailand doesn't care about our thoughts so if you want to show you care, stop moaning about Thaksin, and get out into the community and do something positive (of course, make sure it's listwd on your work permit or else you will be arrested and deported).

Horrendous poverty? I take it you are not widely travelled.

Or maybe he has been to some of the rural areas.

The key, the absolute key to the current situation is that Thaksin was not convicted of political crimes. And nor will the current round of prosecutions. This is the problem for the Thaksin forces around the Reconciliation totem pole. Now that the opposition is on the ball, each one of the proposed charter changes will now be publicly measured against the Thaksin 'benefit'. For the red supporters pushing the Thaksin line, lets see how they measure up with the 'its not about Thaksin' line.

Unfortunately for your argument, the proposed amnesty does not apply to this case.

and where did the 9 Billion Baht go?

The AEC concluded that Thaksin and 31 others were at fault in connection with 9 Billion Baht loans extended by the state-owned Krung Thai Bank to three private companies with links to people close to certain government figures.

It was found that a large amount of money had been transferred from one of the three companies to a bank account belonging to the son of a politician in power at that time.

well if they want a conviction they'd better hope they have more on thaksin in those files than - (from the OP)

The loans were approved when Thaksin was in office.

oh, rest assured, they do. The OP was the briefest possible. More is available here:

Prosecutor Indicts Thaksin In State Bank Loan Scandal

The State Of The Cases Against Thaksin

Thaksin To Face New Corruption Charge Over Improper Bank Loans

On the point of evidence, Thaksin's lawyer Noppadon said yesterday that his boss is not worried as there is "no evidence" against him.

Guess we'll see... when those 17 boxes and 150 files are opened up. smile.png

Incidentally, the other paper has a good article this morning on the topic. A lot more info than just the aforementioned OP's "The loans were approved when Thaksin was in office."

Additionally, there is an excellent graphic with the article that briefly details the current status of 13 different cases against Thaksin with separate categories listed by cases that have been finalized, cases still being heard, and cases under consideration by either the National Anti-Corruption Commission (NACC) or the Office of the Attorney-General (OAG).

It's worth a look as there are numerous cases and they are all in different stages making it not the easiest thing to keep track of.

'17 boxes of evidence'

In the Krung Thai Bank (KTB) case, state prosecutors submitted a writ citing an anti-graft report and 150 files in 17 boxes of evidence.

the lower estimate x 17 = 34,000 pages.

Let's see if any of those have this scrawled on them, Noppadon.

When, if ever, will he be prosecuted for some of the really serious illegal things he's done? Mass extrajudicial killings and funding/inciting riots resulting in death and arson, to name a few.

These are political offences and could easily be covered by reconciliation or amnesty. It is the money laundering crimes and convictions he is skewered by.

Al Capone in Chicago was done for fraudulent tax returns not murder and mayhem. And so it goes with Thaksin.

And if Thaksin is charged, tried, convicted and sentenced will he serve his jail time in the same way Sondhi is serving his?

The only way to know for sure is for Taskin to come home and go through the legal system to find the true answer to your question

except he can not be charged etc etc because Thaksin is not here. At least Sondhi is. (though Sondhi is just as big a <deleted> as Thaksin)

As far as i'm aware Thailand does not have a jury system.

Thaksin is respondsible for killing 3000 people at his war against drugs. With 50% not having anything to do with narcotics at all.

What similar evil did Sondhi do?? Some dogy cheques into which he was tricked.

I can't see that Thaksin and Sondhi are even in the same league. The acts of Thaksin in having thousands murdered, what to speak of the level of corruption he participated in to line his pockets is beyond imagination.

I wonder why Interpol decided to drop Thaksin from the most wanted list that Mark claims.

I wonder how much Thaksin paid, if any?

When did abhisit say that thaksin was on the interpol most wanted list?

I suspect your imagination is working overtime.

Well, even if Nappadon and Amsterdam and stacks of money in cake boxes, ....and all their slick tricks and avoidance tactics and stalling don't get him off, Thaksin can always say, "it was an honest mistake." It worked like a charm before.

The Court at the Hague might perceive the mans misdeeds differently than local prosecutors.

Here's a glimpse of the future, and in ain't pretty: Thaksin being wheeled in to a courtroom with tubes and respirators dangling all around. And we're all supposed to take pity.

I think Suthep did. But then he was the Democrats version of Jaturporn. A big mouth out of control.
