Court to consider Yoswarit plea

THE NATION

BANGKOK: -- The Criminal Court will consider a request to temporarily release red-shirt co-leader Yoswarit "Jeng Dokjik" Chooklom on bail.

Yoswarit's bail was revoked on August 23 after the court found him guilty of threatening Constitution Court justices and their families by revealing their personal phone numbers at a red-shirt rally.

Yoswarit, along with other red-shirt leaders, faces a "terrorism" charge in connection with the April-May 2010 unrest.

The request came with Bt600,000 to be posted as bail and two letters guaranteeing Toswarit's conduct from Justice Minister Pracha Promnork and former deputy interior minister Sermpong Pongpanich, Yoswarit's attorney Winyat Chartmontri said.

The Department of Special Investigation raised no objection to the bail request.

Yoswarit is detained at Bangkok Remand Prison.

Another red-shirt co-leader, Jatuporn Promphan, told the Criminal Court in a libel suit filed against him by Abhisit Vejjajiva that he had no intention of defaming Abhisit.

He said he merely cited the fact that he believes Abhisit was not inside the car that was attacked apparently by red shirts on May 10, 2009, and that his hands were soiled with blood.

Jatuporn told the court that the emergency decree should not have been used against the red-shirt movement as it was meant to be used in the three southernmost provinces only.

This is mental. How can a persons bail be revoked and then re-applied for, with sitting cabinet members as guarantors. No wonder the Thai public at large show such flagrant disregard for the law. The justice minster needs to keep out of this. What we are seeing is the PT government making the same mistakes as the previous democrat led government, by meddling and interfering in the judiciary. If this man is innocent, then let due process take its course like it has to for every ordinary Thai and the truth will prevail.

I fear this guy will walk free today, the only option if bail is refused is for the Justice Minister to resign. How the hell can the Justice Minister be getting involved personally in a process requiring Justice?? If sitting MP's write a letter to guarantee behaviour what is the consequence if he does not behave? Answer....nothing because MP's have immunity.

As for Jatuporn

Jatuporn told the court that the emergency decree should not have been used against the red-shirt movement as it was meant to be used in the three southernmost provinces only.

The Emergency Decree is for emergencies, unless it has escaped his notice, having red leaders inciting the crowd to murder and to burn the city down, and building barricades with razor wire and sharpened bamboo stakes happens to constitute an emergency.

And motor mouth Jatuporn just had to get some coverage, of course, denial. As to the issuing of judges phone numbers - yep that's a good reason to give bail - both these people have total disregard for the law and obviously are condoned through complacency. Any Western Court would throw the book at these two.

Perhaps it was smeared all over his gate, when former-PM Abhisit left home, that day ?

Also listed as a guarantor on the bail application,

former deputy interior minister Sermpong Pongpanich

it would seem that just any sort of guarantor is acceptable as Sermpong was banned from politics after being found guilty of committing electoral fraud for Thai Rak Thai Party while a member of Thaksin's Cabinet. :bah:

By appointing indicted red leaders as party list MPs and insisting they be tried as a group, they have ensured trial will be delayed as long as possible. If being imprisoned on remand is such a hardship, the charged MPs could rescind their immunity and have the trial expedited - highly unlikely given the high probability that they will be found guilty.

But really, there is no real reason that the 3 (or more?) not covered by immunity (Jatuporn Arisman and Yosaworit) could not have their case/cases heard immediately.

( and where farang indignation is of no consequence what so ever )

The game is to just re-apply until you get a friendly judge....

Or until the Justice Minister (oops and one of the guarantee letters is from him) appoints one to hear the case. "There is no conflict of interest here milaud" !

It's kind of like the "suspended sentences" for killers and thieves. When in power you and I can make the laws the way we see fit.

Dokjik was taken to the court from the "political prison" Lak Si to testify.

Dokjik testified that after 2 weeks in prison he felt guilty about what he had done and said that if was allowed to receive bail once again like before, that he would behave and follow the conditions of his bail.

Red Shirt Chairwoman Thida and Pheu Thai Party MP and Red Shirt Leader Weng showed up in support of Dokjik.

After the testimony, the court said it would make its decision tomorrow at 10am.

Wonder how the conditions are in this special prison for 'political prisoners' only. I had confirm that the only political prisoners seem to be red-shirts and with all the help of coughing up bail by Pheu Thai MPs and government surely the shiny new prison can't be overcrowded. Maybe the food is not so good, maybe maggots missing ?

Bail revocation is having its desired effect, so why stop it. Hopefully he will feel the same way when he gets his 50 year sentence, with time off for the remand currently being served. Or he could cut a deal, turn State's witness, and drop a bucket load over his red mates.

Court decides today on Yoswarit's bail

BANGKOK: -- The Criminal Court will decide today whether to allow red-shirt leader Yoswarit Chuklom to be released on bail again.

Yoswarit, a comedian better known by his professional name Jeng Dokjik, had his bail revoked by the court two weeks ago after it found that he had intimidated Constitution Court judges during a political rally.

Yoswarit's lawyer, Winyatti Chartmontree, submitted a new request to the Criminal Court on Monday, seeking new bail for the red-shirt leader.

The Criminal Court yesterday heard the reasons put forward by Yoswarit's lawyer and witnesses as to why he should be freed temporarily again. Democrat MP Nipit Intharasombat, who earlier requested the revocation of Yoswarit's bail, also came to the court to voice opposition to his being released.

Yoswarit told the court yesterday he had spent two weeks in jail to review his statement and felt sorry for his behaviour. He said that if he received the court's mercy and was released on bail again, he would never violate the bail conditions and would be careful not to violate any person's rights or liberty or violate the laws again.

Yoswarit said he wanted to be freed to perform his duty as an assistant secretary to Deputy Interior Minister Thanis Thiengthong and he needed to work to take care of his family.

He said he would send a formal apology to the Constitution Court judges if he were released.

Justice Minister Pracha Promnok and former deputy interior minister Sermsak Pongphanit also testified to the court that Yoswarit would behave after his release.

But Nipit told the court that Yoswarit had been detained for only two weeks. He said Yoswarit should be detained longer so that he would not repeat the same behaviour. There were no new conditions that should persuade the court to release Yoswarit temporarily, Nipit said.

The court scheduled its decision for 10:30am today.

It's a bit of a catch 22 really. the judges seem to have little choice seen as their political boss the Justice Minister has spoken on behalf of the 'comedian'. They seem to be going to a great deal of trouble to keep him out of jail, one wonders why? I can only assume it is to stop him squealing like a stuck pig and turning states evidence!

Shame Dokjik didn't consider the judges' need to work and take care of their families before he incited violence against those same families. ermm.gif

One might take the position that for sincerity-sake it would have been much more appropriate for him to formally apologize to his victims weeks ago. dry.png

What is Dokjik to the Justice Minister and Thaksin's Deputy Interior Minister? Where were their assurances after he was granted bail the first time, before he excitedly encouraged others to break the law and harangue innocent people? :ermm:

Having been here quite a few years i thought i had seen almost everything, then this government is voted in and come out with more tricks than an organ grinders monkey, even to hear this plea is a travesty of "Justice", if it succeeds and he walks the C C will have NO Credability whats so ever

I think that he should have been released on new bail PROVIDED that the guarantors wave ANY immunity and IF he re-offends he goes straight to jail and they straight to jail as well with NO bail permitted for any of them.

Yoswarit's bail request rejected

BANGKOK: -- The Criminal Court Wednesday rejected request of red-shirt leader Yoswarit Chuklom to be released on bail.

The court reason that there was no enough reasons to convince the court that Yoswarit, better known as Jeng Dokjik, had really felt sorry for his violation of the bail conditions that caused his bail to be revoked on August 22.

The loss of face of him presenting a letter of guarantee to the court and they refuse to accept it is massive. Also, those guards need to watch what they are doing Dokchik could easily take his left hand out of those handcuffs.

The other paper's report includes information that both the Justice Minister and Thaksin's cabinet minister testified at the hearing that Dokjik would behave, but that the judges said it was only their personal opinion and thus carried no weight. (more loss of face for the two).

It also describes Red Shirt Lawyer Winyat saying he would secure a letter from Dokjik admitting his guilt and send it to the judges next week. (once again, a day late and a dollar short).

It concludes with the same Red Shirt Lawyer saying that he would reapply for Dokjik's bail again next month. (my prediction was off by a week).

Court stands firm on ex-comedian's imprisonment

BANGKOK, Sept 5 – The Criminal Court on Wednesday rejected a requested temporary release from prison for Red Shirt activist and ex-comedian Jeng Dokjik, imprisoned since Aug 22 after his bail was revoked.

Yossawaris Chuklom, alias Jeng Dokjik, told the court that his time in prison had compelled him to feel remorseful and, if released, he would not repeat the mistake and that he would strictly abide by the court’s conditions.

He added that he would be willing to submit a letter of apology to the Constitution Court and would refrain from criticising it.

His written plea was endorsed by Justice Minister Pracha Promnok and former deputy interior minister Sermsak Pongpanich.

The court, however, said it was not convinced that the short-term imprisonment could lead to the defendant’s remorse. Mr Jeng's lawyer had submitted Bt600,000 for bail bond, but the bid was rejected.

His lawyer said he would thoroughly read the plea for future correction and would wait for the right time to resubmit a request for temporary freedom.

Red Shirt leader Thida Thavornset said the court’s decision was unexpected given Jengs' remorse being attested to by high-ranking officials.

Earlier, the Criminal Court revoked his bail, charging him with intimidating the Constitution Court. Former MP Jatuporn Prompan and 17 other Red Shirt activists, however, had retained their bail intact.
