Expired Thai Passort. Can't Leave Thailand On American Passport Because Lack Of Entry Stamps.

My child has been repeatedly denied exit from Thialand becasue he does not have entry stamps in his valid American passport. He entered Thialand on a Thai passport that is now expired and can not be renewed without the mothers concent (new law). The mother has no interest in her son and we have not been in contact in over 4 years. The last I heard she was in BKK somewhere "working".

Even thought we have showed immigration the old Thai passport they keep tellig us he can not leave.

Since I am unable to get a new Thai passport for him to leave what options do I have? We would really like to visit the USA for Christmas.

Both parents having to sign for passport is not a new law - it has always been the case - but perhaps this also involves child abduction laws. Believe you may be able take legal action if she is not available. You might want to consult a lawyer but not sure if can have paperwork court action done is that short a time-frame.

Your child is in Thailand as a Thai citizen, as such, can only depart on the Thai passport.

Suggest this thread gets transfered to the Family forum? You'll be able to get better advice there, but the essense will be that if you are basically the sole parent, a court can issue with sole rights to the child which will allow for you to do things like that without needing the mother to sign for things like the passport.

From what I've read, Thai family courts are highly reasonable on that front.

A number of years ago my Thai wife wanted to obtain a Thai passport for her son to enable /travel migration to Australia. She had lost contact with the father so couldn't obtain his sign-off. She went to the Amphur and was requested to obtain signed witness statements from neighbours in her Moo Baan that she was the sole supporter of her son and he had been abandoned by the foreign father. She was then issued with a document from the Amphur (cannot remember the document type) that she took to the Passport Office in BKK and he was then issued a Thai passport.

I do not know if the above process is available to foreigners or as advised you need to go through the Family Court, maybe other members of TV can advise.

I agree with Simple1. Go through the family court.

My wife did it to obtain sole custody of her daughters. We had to go before a judge

in his office, not in court. He made an order which we took to the amphur. They

added it to my wife's divorce paper memoranda and we took that lot to the passport

office. Long winded, but straightforward. See a lawyer.
