Hi Mario..

I was married in 1990 (ampher office) to thai lady and we split up in 2007,

I have not seen her since then just emails about kids and bills etc...

Never legally divorsed and we both care for our children I send money to them each month.

All the kids are over 18 now.

I live in Thailand she lives in USA.

Thinking of getting married again here in Thailand.

whats my best course of action ??

I supose get divorsed from ex but not sure of that process either??

You will indeed need to dorce, and there are two option: a divorce in the US or a divorce in Thailand.

A divorce in Thailand would be the easiest and cheapest. If you both agree to a divorce, you simply go together to any amphur in Thailand and file for divorce. At that moment you can enter any agreement regarding the divisions of assets. Otherwise the norm is that you split all assets gained during the marriage (which includes debts).

The only cost would be the travel expenses for her and the cost of a lawyer if you want to draw up an agreement.

Otherwise it will mean going to court in either country. If you can do that in Thailand depends on the situation as under Thai law the court can only grant a divorce on the grounds entioned in the law. Abondonment is the best for your situation, but can only be applied for by the person who was left behind.

As said, check with her if she wants a divorce. If she agrees, that will make it a lot easier and if you can agree on a divorce settlement it usually is a simple proceeding in either country.

She and I both agree on this, We have no assets, Can not afford to have lawyers involved and I'm sure after the official divorse we will still care for each other still family together.

Abandonment is not the issue here from our perspective... (thats just thai law I know),

I read in other post that it may be possible to have her go to Thai consulate in USA (Boston) and that will act as amphor office for her and I can go to my local office...correct?????

Is this an option for us?? anyplace i can read up, get some info on this option on my own?

or Option 2...

Get divorsed in USA with all the grief that will bring. I am not even sure my state even recognises our Thai Marriage although we did register it at usa embassey in Bangkok back in 1990 ,

She is now a USA citizen living there, No more thai ID card No more Thai Passport so to do this back in USA is my best option Now i think.

Your marriage will be recognised in the US without problem, might need to have it certified by the Thai embassy but that is all.

The consular divorce is a good option, but check it will also be recognised in the US. Check with the Thai embassy or a general consulate, not a honorary consulate.
