Report: Thai nationals to be caned for overstaying in Brunei

BRUNEI: -- Two Thai men have reportedly been sentenced to “strokes of the cane” for overstaying their visas in Brunei without reasonable causes.

Sombat Chamnanrop, 44, was sentenced to six months in jail and three cane strokes, while Phaisan Saensimon, aged 32, was sentence to three months in jail and three cane strokes.

The Bandar Seri Begawan Magistrate's Court sentenced the two men yesterday, the Borneo Bulletin reported, after all defendants pleaded guilty to overstaying in the country without reasonable causes.

The two men were apprehended along with Thai female Sirithip Champasaeng during a raid in the morning of May 22, 2013 at the male defendants' rented home in Kg Kilanas.

Anyone know if they give the three strokes at once or weeks apart etc?

This is the procedure in Singapore, but likely will be the same in Brunei

An inmate sentenced to caning is not told when he will be caned,

being notified only on the day his sentence is to be carried out. He is ordered to strip naked; the prison doctor then examines him

to check whether he is medically fit for caning, by measuring his blood

pressure and other physical conditions. If the doctor gives the green

light, the inmate then receives his caning, but if he is certified unfit

for punishment, he is sent back to the court for his prison term to be

increased instead. A prison officer confirms with him the number of

strokes he is to receive.

The inmate is then led to the A-shaped frame (called a "caning

trestle") and his wrists and ankles secured tightly to the frame by

strong leather straps in such a way that he assumes a bent-over position on the frame at an angle of close to 90° at the hip.

Protective padding is placed on his lower back to protect the

vulnerable kidney and lower spine area from any strokes that land

off-target.

The punishment is administered on the offender's bare buttocks.

The caning officer takes up position beside the frame and delivers the

number of strokes specified in the sentence, at intervals of 10 to 15

seconds.

He is required to put his full force into each stroke.

The strokes are administered all in one caning session,

unless the medical officer certifies that the inmate cannot receive any

more strokes because of his condition, in which case the rest of the

strokes are converted to additional prison time.

Caning for serious crimes is ok but I think it's too harsh for overstaying. I mean you're putting overstayers in the same league as rapists and drug smugglers. How many TV posters would a few cuts on the backside if they did that here too?

Just a thought as they were in the company of a Thai lady when caught, could she be caned too, if the Judge had wanted it as part of the sentence?

Or is the cane just for males.

There are politicians in the English Parliament who have paid strict ladies to do the same procedure.

Perhaps six of the best across the bum would be better than a B20,000 fine?

Having watched a video of someone being caned in Singapore (indeed, I could not watch it all, way too barbaric) Ican't condone making jokes about it.

For serious crimes like rape, human traficking or robbery maybe, but for a non-crime like overstaying it's pervert, barbaric and sadistic and belongs in the Middleages. Sick minded retards.

Guess which sick minded retards thought it up, implemented it and left the laws behind. Hint: they were not muslims nor the barbaric natives.

Why didn't you just tell us all the answer?

The genteel, colonial Bwitish in the Malay states introduced the fine art of corporal punishment to the natives.

Since it's over 40 years since independence, one would have thought that the local governments, mostly Muslim, would have banned this form of punishment by now?

Malaysian law excludes the following groups from judicial caning:

  • Women
  • Men aged 50 and above (except when convicted of rape);
  • Any person below the age of 10
  • Any person deemed unfit for caning by a medical officer
  • The insane

Boys aged 10 to 18 may be sentenced up to ten strokes with a light cane

Fellow Thais aren't going to be happy about that.

At least they aren't towing them out to sea to be set adrift and die with no food or water, like the Thai authorities have down to over 1000 Rohingya.

Nice in the computer Graphic, the lashes are being administered and supervised by white caucasians. Don't let the Thai's think for a minute that this is a punishment administered by Asians...God forbid. The guys in the picture look more like members of the EDL than A Balinese Muslim. Still, give it 15-20 years the way things are going and the picture will be quite accurate as most Magistrate courts in the UK will be dishing out a similar punishment !!!

Ok, let's game this out:
So they make this law about the harsh penalty for overstay- presumably to keep foreigners out of the system.
The most obvious logic flaw being: You're a tiny little country that not many people care too much about.

How the hell is anyone supposed to know about your medieval law if they're not from your country to begin with?
And if nobody knows about it before they break it, then how is it supposed to be a deterrent?
And if it's not a deterrent, then what is it?

It's stupid. And childish. And xenophobic. And cruel for cruelty's sake.

... and worse yet, you're giving American Republicans ideas.

Overstaying in Brunei seems like a punishment in itself.

I hope they get a good seat on the plane ride home.

Sentence them to an eight hour stopover at the international airport. They'll wish they'd been caned.

Why not do it in Thailand, may be people would think twice about overstaying, instead of not giving a sh**

Indeed, overstaying is a most heinous crime that deserves the harshest of punishment. I mean if someone overstays it really affects your life and well being. Maybe they could also do it for not doing the 90 day report on time.......not that you would know anything about 90 day reporting, as you've only been here 6 weeks......that's if you're actually here at all? Enjoy your flight home. wai.gif
