2 years overstay

Hi,

heard that very strange story of someone who had '2 YEARS' overstay and just flew out with 20.000THB fine at phuket airport.

As far as I understand the law says 500Baht per day up to 20,000Baht. What happens after? He told me no problem, 5 minutes procedure at immigration, and just one comment by the office "just really like thailand, hae?" .

Is it really true, two years, have 20k THB, no promplem?

That is standard procedure.

Just go to the airport pay the maximum 20,000 baht fine and leave.

Of course doing this is not advised because if you are caught with an overstay it can mean some time in jail.

We had a seven year overstay up here in Chiang Mai.

 

Same thing went to airport with 20,000 in cash and sorted no problem.

He came back couple of months later with no problem

You should have been Blacklisted....Deported....and not allowed to return.!!!

Actually, that's just part of the rule, but the Thai's chosen to have a relaxed attiude about it. I don't consider the guy to be arrogant or agressive for wanting people to obey the law. Perhap's you are the one that should get a life.

What the Thais truly hate is Farangs who think that they are somehow special, and therefore above the law.

While it may be true that the maximum fine for overstay is 20,000 Baht, it is a bit of a slap in the face to the Thai people and their immigration rules when you stay here for many years without reporting.

I have lived here for 15 years, and have been married to a local Thai for 10 years... .

I report to the local immigration office every 3 months, without fail, as required by law.

My comments to you come directly from my Thai family.

I don't speak " agressive ", only the opinions of relatives.....

It would be nice if they started enforcing the jail part of this law. Some people here may think that Thais do not care about some things but because they will not voice disapproval doesn't mean they approve of law breakers

How true...

The law states that if anyone is caught with an expired visa before they are physically standing in front of the immigration desk they are subject to arrest and jail.

She marks the calender with the days when 90 day reports are due and when my extension of stay is due for renewal !

Your remarks could/would be viewed as being offensive by many Thai people -----my wife included!

Deary me... a farang who feels qualified to speak for "the Thais"...feels himself qualified to speak on behalf of a nation...then informs other farangs that what Thais truly hate is farangs who think that they are somehow special. The irony...

For what it's worth, my Thai spouse was sitting next to me, making suggestions, on behalf of more than 300 relatives ( many of whom I have spent a lot of time with ), as to a sincere and respectful reply to the negative posters....

After translating English to Thai...

All I received was a sad shake of the head..

Deary me..... Yes, I feel fairly qualified.

Of course he told her about the date. What the hell is wrong with that ??? I also tell my spouse, as well as mark it on the calendar, so that we can plan other things to do on the reporting day.... ( it is a 5 hour round trip for us, with only 20 minutes required at the immigration office)

what do you want a pat on the back??? you must lead a very boring life as you seem to never break a rule.. some people do it for the fun of it as they are pissed off the way they get treated here by immigration... He pays his fine and then he is allowed back.. no rules broken just bent a little... You should be more worried about the corrupt people of Thailand than a single guy who overstays..

I am sitting here in Laos to get my visa done so that I am legal for the next 90 days in Thailand

While I understand why some want to take a light hearted view on breaking a rule here and there, personally I won't break an immigration one as there is a difference between running a red light or small laws vs an immigration one.

Anyone risking that is playing with an odds that is not stacked in his favor

I am sure the folks here can quote "friends" who have done that before and did not get anything more than pay a fine ...heck I did it myself for 3 days once when I was too lazy to head off to Mae Sai border but 2 years indicate an illogical risk taking that is not clear in the head and I wish the rules are stricter not this application instead of the fine ...$700 USD vs doing the visas right

I won't make a hero out of him , just happy he is not in jail...I cannot think of any western counties where most posters are from where the immigration will ask you to pay a fine and welcome u back next week with a smile.

Singapore will jail you and smack you on your naughty bottom before sending u to the exotic prison island of St John where I can view Sentosa on a lucky day and then deport u home with a permanent blacklist

Well in my book there is a big difference about being aware amd being made aware.

Just tell me why a Thai citizen should be aware of Thai immigrations laws, it is something they never get confronted with .

Same as I never get confronted with the immigration laws in my homecountry, unless my girlfriend decides to apply for a visa.

How many people in your homecountry know what the immigration rules are for an immigrant to your country ?

I live in Pattaya, where there are hundred thousands of foreigners, and in 2 decades here I discovered that almost none of the business people in this city have any idea about what the immigration rules are for foreigners.

Of course the majority know that they need a visa, but that's the end of their knowledge. Of course in your neck of woods things are different.

Once I became involved and responsible with an elderly foreigner, with a serious medical issue which made all traveling very complicated. I was suggested by an immigration officer personally to go for the overstay option instead and just pay the fine when we left the country, and so we did. They just mentioned one can do this without problems when he usually just stays at home. Thus he lived here for almost 4 years without a visa. Once we had to leave the country in advance I went to the immigration office to inform them. The advised: just go to the aiport to immigration checkout and explain the situation, and pay the 20.000b fine. But do take some extra time for it because the officers dislike it when you force them to hurry. The overstay fine issue was handled as a formality, nothing negative. The officers were very, very friendly and asked how my friend was doing now with his health.

What's very important in Thailand is your attitude, always show respect and make them willing to help you. Never come with complaining remarks, arrogance or agression. It doesn't count if you are married to a Thai and think it gives you more 'status', or have lots of money or how long you live here, it's how you interact with the Thais.

Yes, when it appears that someone will die soon and not cause problems, the Thai gov't authorities can be very understanding.

Howerver, the gov't hospitals aren't so undertanding when someone with a long-term overstay shows up, pleading poverty, with a complex medical condition. Frankly, I've seen them "discriminate" on the basis of nationality. Suan Dok hospital, the regional hospital that's part of CMU seems to know that often elderly Americans, Candianas and Austalians will have ties to family in their home countries and/or a regular monthly pension where they can pay their hopital bill within a few months. The indigentent Brits are usually kicked to the curb -- sent to provinciial, not regional hospitals where they're discharged still with raging gangrene from a leg fracture and urinary tract infections becuase no one could speak English well enough to encourage them to drink water.

If the person refuses to leave the hospital (maybe because they collapsed in the lobby), they simply call the police to come "deal with the overstay".

Sorry to be so "down" -- it's just that these guys have so few options. Some of them could have avoided going on overstay, but they just were lazy, gave over all their money to a Thai person or somehow thought they could be clever and "game" the system by paying 20,000 baht when they left Thailand. ( Hah, these guys neve seem to have 20,000 baht to their name). It's not a simple "fix" once you're on overstay and life is very ugly in a gov't hospital for those on overstay.

Oh yeah, those of you on overstay from European countries should know that you're on your own. Most will say "it's up the individual or his family to make prior arrangements." Many Embassy staffs won't visit an overstayer in the hospital to help him sort out his life.
