Judge suggests dismissal of lawsuit in tollway case

BANGKOK: -- An Administrative Court judge on Wednesday suggested the lawsuit against the plan to increase the Don Muang tollway fee be dismissed on the grounds that the fee hike was not against the contract agreement.

Chayin Saengjan said that those not wishing to pay it could take Vibhavadi Road, which runs below.

On Wednesday, the defendants testified that the increase was in line with the contract, which had been checked and approved by a coordinating committee that included the Attorney General and related agency officials.

The case was brought to the court by Udon Thanibased academic Somkid Homnet. He sued former Transport Minister Sophon Saram, former Highway Department chief Weera Reungsuksriwong, the Don Muang Tollway and the then Cabinet over the contract, which extended the tollway concession from 25 years to 27 years and allowed a hike in fees to come into effect from December 22, 2009 December 21, 2014.

The Administrative Court is scheduled to rule on this case in due course.
