My family is moving to Bangkok from Canada in a week. I was asked by my friend what would happen to my 8 month old daughter if something happened to me and my wife. Do families set up wills in Thailand? Is there a formalized "in case of emergency" that we could fill out? Does my daughter's Canadian passport serve as such?

Thanks in advance for your help.

register your arrival at the embassy & ask them if you can include instructions for your child at the same time, who to contact etc. A will is always a good idea.

If both parents are Canadians, the Canadian embassy would be informed and the child would ultimately be put in the care of the Canadian government, who will contact the relatives. Canadian social services would probably place the child in the care of relatives, till a judge can make a final decision about who gets legal custody over the child. That can be contested by different family members, if there are several family members that want to take care of the child.

In a will you can state who you want to take care of your child if you both should die before the child becomes an adult. That normally weighs very heavy with a judge. The older a child is, the more the child will also have a say in this before the judge makes a decision.
