Hi,

I've found myself in a situation that I'm a bit worried about. Basically, I'm becoming a director / partner of my wife's company and thus will need a workpermit. We enlisted a lawyer (Company advertised on this site) to help us through all the legal loopholes. We've followed all instructions to the end and our accountant has prepared all documents.

My passport is now at the Ministry of Labor with the application. My Non B visa runs out on the 22nd and we have now hit a snag. The registration of the company needs changing before they will give me a workpermit. I'm slightly annoyed with the legal company as they should have told us about this months ago. However, I fear this will not be sorted in time and thus am planning for the worse.

So, if I take my passport back and fly to Malaysia, can I get another Non B visa? My orginal one was for 3 months as I was told this would be plenty of time. Obviously it wasn't.

Any advice or suggestions appreciated.

Should not be a big problem, but try to get a letter from the ministry explaining the wait on the company registration or at least have one from the lawyer.

I am going to submit my WP1 application for a work permit (teaching) on monday in Nong Khai however I thought they just keep a copy of your passport not the original - the reason I am concerned is because I was intending to then go to immigration with the receipt from the labor office to apply for a 12 month extension of my non-b visa

do I have a problem ?

I am going to submit my WP1 application for a work permit (teaching) on monday in Nong Khai however I thought they just keep a copy of your passport not the original - the reason I am concerned is because I was intending to then go to immigration with the receipt from the labor office to apply for a 12 month extension of my non-b visa

Labour will not keep your passport, they just need copies of the pages of concern.

Don't know why the OP's passport was retained, he will need a full set of papers again to apply for a new 90 day single non immigrant 'B' Visa including a fresh WP1 receipt and possibly a Letter of Approval from Labour.

Hopefully he can sort out the changes quickly with the commerce dept, they are pretty efficient in my area.

Labour will not keep your passport, they just need copies of the pages of concern

When I first received my Non B from Kuala Lumpur I didn't have a receipt from the Ministry of Labor - just all the documents and accounts from the company. So, I'm guessing that since my application now resides with them that I should be able to get the receipt. I'm thinking that this with a letter from the lawyer and the Ministry will hopefully allow me to get another Non B.

As for why my passport is at the Ministry ... I have no idea. The lawyer requested it along with all the documents to submit to the Ministry.

Also, someone mentioned that I can extend for 60 days if my wife is Thai. Does this apply even though my Non B is a business Visa and not a marriage visa?

Yes, getting a 60 day extension based on your wife is no problem.

No financial proof required, but need wife, her ID-card, household book and marriage certificates plus copies of those.

You can extend with 60 days on any entry, even a 15-day visa exempt stamp.

Extending your stay with 60 days on your non-B will keep the non-B entry valid.

In my area (Phuket) Labour will not accept the 60 day 'Visiting Thai Spouse' extension as a valid basis for the issue of a WP even if the extension is for a 90 day Permission to Stay Stamp issued against a Non 'B' Visa.

Best check with your local Labour Dept if you are looking at going down that particular route.
