Is it possible to convert a Non-O to Non-B without having to leave the country?

I was told that someone who has a Non-O based on a thai son cannot hold a work permit...is that true?

Firstly are you talking about a non immigrant category 'O' visa obtained at a Thai consular facility outside of Thailand?

Or are you talking about an Extension of Permission to Stay based being a family member of a Thai obtained from your local Thai Immigration Dept (National Police Order 777/2551 Case 2.18)?

im talking about the Non Immigrant O visa obtained outside of thailand. Haven't entered yet

In answer to your initial question, if you have secured employment in Thailand, then most Labour Departments will issue a Work Permit against your employer's application supported by your current Non Immigrant 'O' based 90 day entry stamp.

During the last 30 days of your 90 day Entry Permission stamp period you can go to your local Thai Immigration and if eligible get a one year Extension of Permission of Stay based on working in the Kingdom of Thailand (National Police Order 777/2551 Case 2.1).

Here is a list of requirements:

If you live with and are the legal guardian of your Thai Child, then it is also possible instead to get an extension of permission to stay based on being a family member of a Thai (National Police Order 777/2551 Case 2.18). You can use your employment and salary (If >40K THB pcm) along with certain company details and tax payment records as evidence of income to support such an application.
Providing you have a one year (2.18) extension against a Thai Child then yes, Labour will issue/re-issue WP against this particular extension of permissin to stay.

New to all of this !

Why would someone wish to change from an "O" to a "B" ?

Would it not be easier to apply for a "B" in the first instance ?

For example if you have Thai family, but do not have a job in Thailand then you can get a non immigrant 'O' visa, but it can be very difficult to get a non immigrant 'B' visa without the support of a prospective employer.

I already got a non-o and then employment was offered. Did you ever think that each person has their own set of unique circumstances?

In Thailand paper work is rarely straight forward.

There is a specific special procedure that allows this to be done in I think BKK only using form TM87. However you must first show that you are eligible for a Case 2.1 777/2551 One Year Extension of Permission to Stay - but for this you would need a WP.

Your local labour dept will almost certainly issue your WP against a non 'O' (unless it is marked 'For Retirement Only') you can then later extend this non 'O' Immigrant 90 day entry just as easily as a non 'B' Immigrant 90 day entry.

You cannot get a non-immigrant of one category get converted to a nonimmigrant visa of another category.

Having entered Thailand with any type of visa or even visa-exempt allows you to apply for a work permit. It is to pick up the work permit when it is ready that you need a non-B visa or, allowed by most immigration offices, a one-year extension of stay for the season of living with Thai wife.

As said there is no need to change visas and it is also not possible to change from one type to the other. Conversions/changes can only be done from a tourist visa or visa exempt entries.

For work permit attach a copy of you child's birth certificate to the application and it should not be a problem.

of course as I and everyone here thought, it is not a problem to get a WP with Non-O based on child. Some HR Consultant told me I couldn't get a WP until I sent them digitalcromackey's response lol.
