I am a Farang who had a scary minivan accident Saturday night in Phuket with 7 of my co-workers. We had spent a few days with our company based in Shanghai on a team building trip volunteering at an orphan school and on the way back to the airport, when a 'drunk' driver did a U-turn on the side of our road while we were at 70km/h. We hit the car, span around and cross the opposite lane where we were hit by another minivan coming on the other way before finishing onto the embankment on the right side of the road.

No seat belts, so everyone was thrown around. My pregnant gf was the most badly hurt as she hit the roof before breaking the side window with her head. Luckily people came quick as well as emergency and only one had a minor head trauma, but all were able to fly back to China that night.
My gf and I were at Bangkok Hospital in Phuket for two more days as she was suffering from neck and head injury. Luckily she didn't lose the baby but she may have to deliver it earlier due to the shock and may have complications.
I was wondering if anyone knew what steps needs to be done at this stage as the driver is 100% responsible for the car accident and could have killed us all.

I'm glad your wife and baby are fine but I doubt that much more will be done.

Any more details from the scene? Did the drunk driver flee?

The owner of the minivan came to the hospital with us and our driver did very well during the accident too. So yes, they have been to the police to fill a report, since the minivan is also out of service for 3 months. Thanks to the camera on the scene, the paper we have says that the driver of the sedan car is 100% responsible. We have met her and her parents at the police station yesterday, but she in't very cooperative and saying that she doesn't have money. She is buying time, so this is why I am wondering if taking a lawyer would be more effective.

Lawyer wont help I think, this will only slow things down. Try to get her arested until such a time that she can pay, I am sure she will suddenly find some money

I'm not sure here, but I don't think you're a party to the guilty sedan driver. I think your actions should be aimed at the minivan company, they should take care of things with the sedan driver, and the minivan insurance, which (provided it was legal) also has insurance for the passengers.

We have another meeting scheduled for Wednesday with her and her parents at the police station. One interesting bit is that her car was seized by the police and was only supposed to be given back at the end of the litigation, but her car was not at the station yesterday, which could mean that she already found a way to get it back.

On our side, we have one person with head trauma, another one with head and shoulder trauma and potential pregnancy complications. We were suppose to fly back Sunday and have to stay until Thursday and Friday. We are all missing days of work + trauma.

The accident happened just when we were gaining speed for the hill leading to Patong coming from Karon. Heavy rain and traffic, so it's honestly a miracle to still be there.

Any compensation for your expenses should be paid from the minivan insurance policy. The minivan insurance should cover passenger damages. Assuming the minivan was legal and properly insured. You do not need to be involved with the other driver.

Yes, that is my feeling as well.

It may help in this to go to the police and make up your own report. Relying on them when they are the ones who should be compensating you is not a good idea.
