Can someone point me in the right direction. I have an O visa (married to a Thai) how long can i remain in Thaialnd after the divorce?

Some people say 7 days, and some say you have to leave that day, so which one is correct? If you can stay for 7 days can you shcange the visa from O to say a B or retirement without leaving Thailand by going to the local immigration office and applying? If not just leave the country and come in on a 30 day visa and change it to a B or retirement visa at the immigration office?

Any suggestions Thanks

If you have an extension of stay their is no 7 days unless you apply for it at immigration. You would need to go to immigration on the date you divorce is final and apply for the 7 days (1900 baht) or some other type of extension such as retirement.

If you have a multiple entry non-o visa you would not need to do anything.

Make sure you have 800,000 in the bank in Thailand for 3 months or can show an income of 65,000 a month or have acombination of yearly income and money in the bank in Thiland (and are of course over 50 years old) and they will extend based on retirement.

I have an O visa whch will last until Jan 2015. i have 800,000 in the bank in Thailand which has been there for the past 10 years. The day that my divorce is final I would need to go to immigration and apply for say a B visa with the documents from my work. Then there is no need to leave the country great

Thanks

You don't apply for a new visa, only cancel your current permisison to stay because of your divorce (take some proof with you) and at that time apply for a new permission to stay based on working with all required documents for that. (On an extension based on retirement normally no WP is issued).

If you truly had a valid non-o visa you would not need to do anything. It appears that you have and extension of stay (it is not a visa) based upon marriage.

You cannot apply for a non-b visa at immigration.

You can however apply for an extension of stay based upon working. You will of course need all the required documents from the company to get the extension.

Thank you Mario 2008 that is what I was thinking. Ubonjoe sorry but I do have an O visa and I have been using it for the past 10 years as I work and I only use this visa it is renewed every Jan that is why it expires on Jan 2015. I think what Mario is saying makes sense well to me it does but this is Thailand. I also have to go to my Local office for the divorce not the court.

Thanks for the impute

If you truly had a non-o visa you would be making border runs every 90 days. You have an extension of stay based upon marriage you have been applying for at immigration. I am sure your non-o visa expired many years ago or no longer exists if you have gotten a new passport since it was issued.

Why would I make border runs every 90 days I report to my local immigration office every 90 days? And when I got my new passport last year all the information that was in my old passport concerning my visas was transferred into my new passport.

If you look in your passport you will find nothing that says you have a visa of any kind.

You have a stamp that has annotations of last visa entry. And the rest say extension of permit to stay. And possibley a re-entry permit.

Reporting to immigration every 90 days is indicative of the fact that what is in the passport is an "extension of stay" not a visa.

Thats strange I dont have a re-entry stamp Oh maybe that is because I have not left here in 10 years. Strange

What is strange ?

A re-entry permit is easily available to those who ask for one. These permits are not just routinely handed out and there is an associated fee of 1000 or 3800 Bht depending on whether a single or multl-entry permit is required.

I have been here a long time . I do not have a current visa but I do have an "extension of stay"

An extension of stay given by reason of marriage ceases to be valid once the marriage is dissolved.

Your option(s) are set out clearly in previous posts.

I do thank you for your impute, and I think I will talk to Immigration and see what they have to say. I suppose it depends on what office you go to as to the answer you get. Once again thanks

Perhaps once you have sought the advice of the immigration officers you could report back here with details of the outcome?

Sure that is not a problem. I also have asked the lawyer who is going to handle the divorce the same question as this is his area. For I have to know so as to get the proper paperwork ready from the persons that I work for, but I will let you knwo what he says.
