Where is there any assumption in my post? or are you referring to the "IF" part? Maybe I'm not connecting the dots here? or do you mean it's an assumption that TVF members would be behind bars? of course it is an assumption, as the defamation laws are stupid, that's the point.

It's like trying to sue MacDonalds for being fat after you've eaten 3 1/4 pounders with cheese, 2 fries, and 2 larges cokes to go.!!

The reference to people in glass houses isn't an assumption either, as all one needs to do is look at the anti Thaksin group and the anti Suthep group, and see that there's a group of individuals on both sides who use terms like "terrorist", "fascist", "Thug". "murderer" who in my opinion are openly defaming Abhisit, Suthep and Thaksin,amongst many others, calling people murderers, and terrorists who haven't been convicted is a defamation, and I'm very surprised that TVF doesn't clamp down on it, but then again, the posts wouldn't be so "entertaining".

Anyway, it's all moot, Jutaporn isn't in Prison, the laws of the land and the courts decided that, and it seems to gall some of the members that he's not behind bars. The court in this instance didn't see the need for a custodial sentence.. get over it, as I'm sure there will be other opportunities arising for that!!!

Just hope the military have the balls to push ahead irrespective of any flak likely to come from a few and round up all the leading trouble makers, those promoting and assisting in violence and get them to a military court on charges of murder, instigating murder, attacks on mainly peaceful protesters etc. The only way to clean up the mess is to completely remove this scum once and for all from all contact with the vunerable easy lead sheep they have been using for years for their dirty work.

And while they are at - an international arrest warrant for the fugitive and convicted criminal Thaksin would be something worth doing ASAP before he has time to find a bolt-hole somewhere like Chad, Niger, Somalia when no extradition treaty exists with Thailand.

As is clearly shown by the recent actions by the Thai Navy against two reporters at Phuket Wan newspaper and reporters at Reuters over their stories that alleged Thai Navy involvement in the trafficking of Rohingya, defamation suits are used to stifle dissent and the views of political opponents. Yes, there are many countries that have such statutes on the books but they are used for the same reason. In Thailand, the use of libel and defamation suits has gotten completely out of hand.

It is my understanding that a person who is charged with defamation or libel must be able to show that his/her remarks were the truth and that the remarks were made in the public interest. Since the murder charges are still pending against Abhisit, we still don't know whether the remarks he made have a basis in truth or not. The allegations made against Abhisit involve abuse of power and are certainly in the public interest. Politicians and public officials in Thailand and many other countries in the world just need thicker skin instead of running off to court all the time. It comes with the turf.

The current case against Abhisit isn't about whether he "ordered the army to kill red shirts". So the result of the case wouldn't prove that one way or the other.

If Jatuporn can't prove that Abhisit made any such order, then he would be guilty of defamation.

Sounds as though Abhisit walks the same line as the young Ferrari driver. Case goes on forever until forgotten.

Maybe Abhisit's case will move as fast as this case and finish in 2 to 3 years.

The title that the UDD have chosen is a misnomer. Ask any politician or anti-government protester who has tried to campaign in the red shirt strongholds...!!

And do you think that the "untouchables" of the PDRC should also be looking at custodial sentences? or do you just wake up in the morning, wash your face with lemon juice, wipe your backside with sandpaper, and swallow some of the said lemon, so that you can't see past the bitterness and contempt that you have for a particular side?

Next time you buy counterfeit goods, or get on your moped or behind the wheel of a car over the limit, or go over the speed limit, just remember that you're also breaking the laws of the land, so get some of the black paint that's normally reserved for the kettle wink.png

Isn't it just indeed, which is the whole point, there's people here on TVF doing it all day, day and and day out, don't you agree that it's every bit as ridiculous?

And NO I don't think Artisi does all these things, they were merely examples of the day to day stuff that many many people do, and I suspect, though cannot confirm that some TVF members do. I couldn't care less if they did, that's down to them, the point was that there are people in glass houses, and well they know it, that post accusations day in and day out, without any substance.

I was using Artisi's post as an example of pot calling the kettle black so to speak.

Artisi could very well be a pillar of his community, and is a straight down the middle guy, I'm sure he's well respected I certainly don't have any malice nor anything against him.

I'd just like to see you post the very same thing you posted on the "usual" suspects on both sides when they use the words like "terrorists", "murderers" etc, then I will give you a round of applause, I hope that you view their attitudes with as much disdain as you do mine?

Only in Thailand can you do prison on defamation charges.

Would be nice if that were true but many nations have criminal defamation laws as opposed to just being a civil matter. In fact there are a even number of states in the US with criminal defamation laws that could land you in jail.

The funny part is the UDD will turn on them if they make a decision that does not satisfy them.

Basically we live in a country that is supposed to be a Democracy where 48% of the people tell the other 52% what to do and has on one side the PTP trying to turn it into a dictatorship under the Shinawatra clan and a group of armed thugs in red shirts trying to turn it into a dictatorship under a rotating leadership of communists, thugs and buffoon's.

Fortunately we have a wise and merciful army to protect us.

Far from being biased the courts have been the saviour of this country with the judiciary just about the only body relatively free from corruption and favoritism. It always strikes me as funny (sad really) that when the UDD lot get a judgment in their favour you don't hear about the bias of the courts. But when the judiciary finds against them, then the courts are biased, in Suthep/Abhisit's pocket/part of the elite and so on. Without the judiciary we would now be living in a country controlled by a hereditary dictatorship with Thaksin at the top telling people to follow his line .... or else. Jaturporn is Thaksin's rotweiller. He's been mouthing off for so long, threatening the state, threatening anyone who stands in his way. I note that the 'biased' courts didn't imprison him, but in effect what they've done is to tell him to behave a bit better than he has done in the past. Really, this man is a monster. Have you ever seen him face to face? I have, and it was not pleasant. An imporant part of Thaksin's campaigns has been/is to control the judiciary. He isn't the only would-be dictator to have done this because if you want to take total control, then you have to usurp the judiciary. Using bias as one of his tools in his kit bag has long been part of his modus operandi.

I completely agree! It's about time all those people who took the airports hostage a few years ago were given prison sentences. And the "easy lead sheep" are finally out of Lumpini Park, so it should be easy to herd them into jail. Good work Artisi! Keep the faith and we'll clean up this country together!

I think you mean 'suspended prison terms'. I doubt any of the wealthy jokers involved over he last few years will even see any jail time. Even Thaksin could have been bailed. Only the poor go to jail here.

The thing with the likes of Juttaporn, and those with his mentality, is that justice will eventually prevail, and he will eventually end up behind bars, or worse.

There's no point in getting too wound up about it, there's career criminals in the UK who had been doing the same as he has, as in break the law, for years and got away with it for years, the " Noonan's" in Manchester being prime examples, but the law and justice will eventually catch up with them

Two-year suspended jail term for Jatuporn on defamation case

BANGKOK, May 22-- Thailand's Appeals Court today handed down a six-month prison term with a Bt50,000 fine for United Front for Democracy Against Dictatorship (UDD) leader Jatuporn Prompan,but commuted the sentence to a two-year suspended jail term for the defamation case against former prime minister Abhisit Vejjajiva.

The red shirt icon showed up at Bangkok’s Ratchada Criminal Court this morning to hear the Appeals Court ruling on the defamation case filed by then premier Abhisit.

The Democrat party leader had filed his lawsuit against Mr Jatuporn, citing that the UDD leader had made speeches from January 29 through February 15, 2010 falsely accusing Mr Abhisit of ordering the murder of anti-government protesters in 2010 as well as his dismissal from military service.

Regarding the accusations of the dismissal from military service, the Appeals Court said that Mr Jatuporn had no intention to defame Mr Abhisit, prime minster at that time, and that the speech was aimed only at making comments on that matter.

Meanwhile, the court upheld Mr Jutuporn's six months in jail sentence but gave a two-year suspended sentence on the defamation charge for accusations made against Mr Abhisit of ordering the killing of the anti-government protesters in 2010.

The red shirt leader was fined Bt50,000 and ordered to publish the verdict in a daily newspaper for seven days. (MCOT online news)

So basically they freed him.

2 years where he is not allowed to break the law or defame anyone else.... Well, I suppose all it will take is someone else to sue him and that case will pull up his sentence and off he goes.

I guess there are many to chose from, he has defamed just about everyone not aligned with the Shin clan at some point or other.

I assume he has been charged with other offence which he has not yet been found guilty and sentenced therefore the Judge can not consider them as previous offences.

A none violent crime, suspended sentence for first offence a good call.

Would they? So you're quite familiar with the laws regarding defamation in EVERY country then?

I would suspect the opposite, in that many countries don't see defamation as worthy of a custodial sentence, what is more likely the outcome is that the accused would have to pay punitive damages to the person he accused/defamed.

I would suspect the opposite, in that many countries don't see defamation as worthy of a custodial sentence, what is more likely the outcome is that the accused would have to pay punitive damages to the person he accused/defamed.

Consider watching the loads of videos with his endless threats, and ironically, threats that were violent, and in many instances, the following day such things occurred. He shouldn't avoid punishment alive.

Oh don't get me wrong Gemini, I've seen and read plenty of bile come from this guys mouth, and as I said the likes of him the law and the judicial system will eventually catch up with him, the unfortunate thing, and fortunate for him, as the in this case, it was about the Abhisit case, and that the courts are unable to use anything outwith that case against him, the law, and the judges would possibly have loved to have thrown his ass in jail for a very long time, however, they couldn't as the other charges against him had no bearing on this case. A 50,000 baht fine is nothing to this guy, a drop in the ocean.

What goes around comes around, and sooner or later, Juttaporn will be back in the dock, on the other charges, where he may not fare so well ;)
