Immigration database flagged me as overstay

Featured Replies

Funny encounter at the airport today. I am in Thailand on an extension of stay based on employment and have a multiple re entry permit. Every now and then I travel so never in the country longer than 90 days, so no need to do a reporting at local immigration office. Anyway when trying to leave Thsiland today the immigration officer looked at his computer and started discussing with his boss that computer says I am on overstay. Boss looks at passport and says it must a be a mistake. Guy struggles a a few minutes with his computer, then gives up with a 'Mai pen rai' and stamps me out. Wonder what will happen when I return...

Could it be that you are not reporting to immigration every 90 days - I don't think the entry/re-entry on the same visa restarts the clock for that.

90 day reporting is just that, you must report when you are continuously in the country for 90 days, Everytime you reenter the clock starts ocer even with a re-entry permit.

Even if you miss a 90 day report or even a series of 90 day reports, you are not on overstay as long as your extension is still valid. Your stamp trail shows you are OK so I wouldn't worry TOO much.

To err is human. If you really want to mess things up, get a computer.

Correction - to miss 90 day reporting is to be on overstay. But the guy clearly says that he is never here in Thailand as long as 90 days without leaving on a Re Entry Permit, so this is not the reason. This seems to be a input error by a immigration-clerk missing to complete the immigration-computer.

How does missing your 90 day report put you on overstay? Immigration goes to great lengths to ensure everyone that the extension of stay is a different process than the 90 day report and not to confuse the two. The mistake in the past has been people going to immigration getting their extension of stay and then thinking this process includes the 90 day report which is due say in one month. They reset their 90 day report and then when they arrive for the report they are horrified that they owe a 2,000baht fine for missing 90day report.

90 day reporting has nothing to do with overstay.

2 totally different processes.

A late 90 day report is certainly not a an overstay. An overstay is going over your permit to stay date.

I am not even sure immigration keeps 90 day report records in the same database as entries, permit to stay and departures and etc.

OK I apologize for being wrong. But I based that on the fact that Khon Khaen debited me with overstay 500 baht per day for my late 90 day report.

How does that being explained than Lite Beer and Ubonjoe?

Probably because you were not aware that a late report is not not an overstay and that the normal fine for it is 2000 baht.

You have bought Somtam for the whole immigration office laugh.png

by not doing a 90 day report, you are most certainly NOT on an overstay,.. its a fine only usually THB 2000 upto a maximum of THB 5000
