Allegations of mistreatment made against Pattaya Police

PATTAYA: -- On Wednesday the Mother of a 28 year old man, who is currently facing attempted murder charges, reported alleged mistreatment of her son by Pattaya Police after he was refused Hospital treatment for serious injuries sustained during the incident in question.


Khun Narubon aged 45 requested the local media to highlight the case involving her son, Khun Wachira aged 28, who works at the Happy Fool Karaoke Bar in South Pattaya. He had been in dispute with a fellow worker at the bar for some time and on Tuesday, Khun Wachira was allegedly assaulted by the other man and 12 other accomplices.

During the altercation, one of the attackers produced a knife which Khun Wachira was able to take from the man. He then frantically waved the weapon around in self-defense. At this point Police came and arrested Khun Wachira despite him claiming to be the victim.

Khun Wachira was seriously injured and, according to his Mother, needed urgent medical attention. Instead he was placed in a cell at Pattaya Police Station and due to the seriousness of the crime he was refused Bail. He was also refused Hospital treatment as Police claimed they had no one to escort him to a medical facility.

Nothing wrong with clear, concise messages. I hope the other fella had a similar experience. When the Police gain some respect then Thailand will be a better place. Locals, Foreigners who live here and visitors who come here should respect a " code of conduct " of some sort. I don't think it's very clear to many- but there is always hope !

A few more " wannabe tough guys " given a good kicking by the Police is a good starting point. Apply it everywhere where lawlessness seems to prevail !

I wonder what constitutes serious injury?

Some contradictions here.

Mostly I have seen that 'suspects' are sent to hospital first for treatment, when they have been arrested dancing in Sukhumvit with a traffic cone on their head after crashing their truck into a row of bikes and food carts.

Then there are the mothers whose son can never do any wrong despite having been arrested while swinging a bloodied knife around.

The police do open themselves to counter claims if they do not treat an injured suspect, despite the inclination and indeed desire for them to be chucked in the cell by their ears to rot!

So you feel society would be better if police officers gave "...a good kicking" to any/all "wannabe tough guys"? What defines a "wannabe tough guys"...also, why should the police stop there? Why not give "a good kicking" to all the people leaving bars who apparently had too much to drink; how about the people just standing around/loitering/gossiping in some public place; the men who forgot to shave; anyone with body odor; jay-walkers; people wearing those ugly rubber shoes; people who walk three or four abreast on the sidewalks?

Perhaps you should make a comprehensive list of people who should get "a good kicking" from the police and distribute copies to all of the stations!

More interestingly, he was refused bail because of the seriousness of the crime. If I think back a little, i can't help but feel that bail seems to be granted like toliet passes in Thailand, where murder is involved.

Or maybe they have finally realised the error in granting bail to high risk runners. Or maybe this kid is not from money. Place your bets here gentleman, although the odds are greatly tipped in one direction.

I hope the police respond publicly to this claim. It doesn't sound good for them but I suppose judgments must be made as to how serious a person's injury is when they request to be moved from a police cell for medical attention. I assume no real harm came as a result of the injuries to the knife-wielding man who was taken away by the police. If he had died or suffered serious consequences because of the police's judgment call, we can be sure the man's mother would have mentioned it.

Mistreatment? If the Pattaya Police had beaten the crap out of him while he was in custody...then we may have some cause for alarm...

When the police take someone into custody, they are responsible for the safety, health and welfare of the person arrested. This includes prompt medical treatment, regardless if the injury occurred before or after the arrest.

Visit Soi 9 Police Station to confirm this. They are open 24/7.

The police, in most countries, use a minimum of physical force to:

Affect the arrest

Protect themselves and others from injury

And to stop the threat

Whatever constitutes a "good kicking..." would be extremely difficult to articulate in a court room as a defense matter.

I've never seen the definition of "wannabe tough guys" in any statue, ordinance or codified law. I've also never seen or used it in any crime report.

When I wore the uniform, I'd be hard pressed to explain in court why I had given a "wannabe" a "hard kicking". I would have been reflecting on my past actions during my stay at the Cross-Bar Hotel had my use of force been judged unlawful.

"Those that advocate gratuitous violence are in the same company as those that commit it".

The Sawang Boriboon Foundation is often at Soi 9 treating both victims and perpetrators after being called in by police. That one case slipped through normal procedure is not surprising given the number of cases there daily - if in fact the mother's story is totally factual.

You do not have to go to hospital to be medically assessed, yes a one sided story... I can only echo your last 9 words.

It is not only in Thailand that mothers, family and friends can not accept the facts often inventing their own.

Mothers Appeals For Her Sons Justice In Pattaya

PATTAYA – September 10, 2014 [Pattaya Daily News]; at 00.10 am reporters were informed by a Mrs Nilubol Pomthaisong aged 45 who asked for justice for Mr.Wachira Lasa her 28 year old son after he had been attacked with a piece of wood and knife by 13 men, so he fought back with a knife. Later the police intervened in the incident before prosecuting Mr.Wachira in act of trying to kill others. The incident occurred near the Happy Full Karaoke, South Pattaya.

Mrs.Nilubol revealed that on August 19th his son who was working in the karaoke shop and said that he had a problem with a work colleague. The colleague then called 10 friends who used knives and pieces of woods to attack Mr.Wachira. Mr.Wachira was severely injured but he picked up a knife which had been dropped by one of the attackers and slashed one of them in order to protect himself.

Later when the police officers turned up to the scene they found Mr.Wachira still holding the knife so they arrested him in the act of trying to kill others. Plus Mr.Wachira had been jailed, although he was injured. After his mom found out she went to meet Pol.Lt.Sanan Kotanan-inspector of Pattaya- and asked him to take her son to hospital.

The part that clarifies things in that new report is this ...

"At 20.00 pm of the same day, the police officers took Mr.Wachira to hospital. Upon inspecting the doctor said that he suffered a fractured orbit and he needed to stay in hospital. However the police officers claimed that there weren’t enough officers to monitor him so the doctors gave him some antibiotics before the police took him back to the police station. His mom had tried to bail him out but he had already been sent to Pattaya remand prison."

I took your advice Benmart but no one was available to talk to me, I think they were all at the hospital with there injured inmates ? :)

Chat with the foreign volunteers that are there. They seem to know what goes on. :)

It is perfectly plausible that the Wachira's version of events is true. We often hear of gang attacks on individuals here.

The doctor's opinion was that Wachira should remain in hospital, due to his injuries (which, coincidentally, tend to support his version of events - that he was attacked).

The police chose to override the medical advice rather than reorganise their resources (or maybe pay overtime) so that Wachira could receive proper treatment under police supervision.

Whether or not Wachira was acting in self defence, he should have received proper treatment for his injuries. Doctors decide what is proper treatment - not the police.

His mother is to be admired for taking her stance against this mistreatment. It isn't easy for an individual to stand up to authority - especially in Thailand, where everyone is expected to know their place.
