Do we need both marriage certificates to get divorced in Thailand?

I want to get divorced from my crazy thai wife, we both live here in the UK but i want us to go to Bangkok to get a quick and "cheaper" divorce, we have a child together and i recently (9 months ago) got a mortgage on the house we live in, obviously if i have to sell this then i will not nearly get as much as i paid for it so would owe the bank a massive amount, of which i could not pay back, so how would this work in terms of my wife getting 50% of everything i own? By selling the house it'll put me into serious debt which i would have to go bankrupt for as i dont earn a lot.

Do we need to take both marriage certificates to the Amphur in BKK? I only have one, the other one was given to the UK government registry office when i registered the marriage here in the UK, so i cannot get the original back, only copies sad.png

I knew i should have listened to everyone who told me not to get married lol

Do you know if i can get the divorce document translated into English before i sign? Or can they only be done in Thai? I hate the idea of signing anything that i can't read

It's a simple standard form, all in Thai, but you're supposed to take a Thai speaker with you as your friend and supporter (with all their ID to witness the divorce). The boss of the Amphur office, won't do the divorce unless he is certain you understand the agreement. And you soon to be ex, isn't allowed to be your interpreter.

Don't know anyone? hire the hotel receptionist/local teacher/bar girl/etc., anyone that can speak basic English is OK.

Bung them 1,000bht for their trouble (can take anywhere from 30 mins to 2 hrs).

I am a little sceptical about you getting a divorce at the Amphur as easily as that. When I got divorced there it was easy as we both spoke Thai and could answer two questions correctly.

Question one. Have you any children together? Answer No.

Question two. Have you any shared property? Answer. No.

In your case you have a child and property together.

We also needed both copies, mine and hers, of our marriage certifacate. As I had lost mine we had to report the loss at a police station (cost twenty Bt) and give them the police report in lieu of the original.

Ok, so as we have a child and property together, what documents will i need to take with me? any ideas? i don't want to get all the way to Thailand and then find i needed a certain document so have to fly back to get it haha.

Sorry, I am not in a position to advise you. Approaching a lawyer seems the best option but a lawyer in the UK will have Pound signs in his eyes to sort out a divorce. Try to do it over here. Perhaps you can contact a lawyer over here before flying.

He is absolutely right. If you have no equity in the property there is nothing to split except debt. Best o give her some cash, maybe half the down payment and keep the house if you can,

For furniture, car, and such, come up with a reasonable fare market value and divide that by two. You can buy her out and you don't always need the cash to do that. You can make payment as long as it is reasonable. For example a dollar and month is not reasonable.

When it comes to courts and divorce, the more paperwork you have the better. I believe you only need one divorce marriage contract, but having the original copy of yours, and your UK Marriage Certificate won't hurt to have and bring along. While in Thailand, it is not like you can zoom home and pick up the papers.

You will not be able to simply go to the amphere to both consent to a divorce if you have a child together. If you say your wife is crazy then it is unlikely she will consent to divorce without a settlement despite you saying you have no equity in your house. The only way I can see you divorcing here is through the court. PM me and I can give you further information.
