The dbd allowed me to open as an activity learning center.

They say I can have as many learners as I like within safety .

The moe say if I have more than 7 learners, I must register as a school.

That would be impossible as all learners go to a formal school already, and come to learn only one hour after school.

Who is right??

From previous posts I think its MOE. But you may be able to get away with 7 or less per class.

The private school act states in section 5

"This Act shall not apply to (1) An educational establishment having a total of not exceeding 7 students."

IE more than 7 in total and you need to register as a school. The original Thai version is clearer than this translation and states 7 students since opening.

Under Non-formal Schools

"Section 120.The establishment of a Non-formal School shall require a license from the Licensor."

“Licensor” means
(1) the Secretary-General the Private Education Promotion Commission.
(2) the Director the Office of the Education Area assigned by the Secretary-General of the Private Education Promotion Commission, or
(3) The provincial governor assigned by the Secretary-General of the Private Education Promotion Commission.

Under Penalties:

"Section 147.
Any person who establishes a Non-formal School without permission in accordance with Section 120 shall be liable to imprisonment for a term not exceeding one year or a fine not exceeding twenty thousand baht, or both."

I think ( not really sure) that it stands for Department of Business Development. Ministry of Commerce.
