Hello, Sawadee kub,

Due to the case that this is my first post here, please be lesient with me, if I did anything wrong.

I have an question regarding my overstay. Unfortunately I am overstaying in Thailand since the last ten month (I know this is a very bad behaviour, but I am willing to clear it now).
I have the chance to sort things out. I got a job offer in a school in November and I am ready to pay the 20k baht fine.

So, my questions is: Is there any chance to pay the fine, leave the country on the landway (laos, for ex) without getting a blacklist and immediately come back with a tourist visa (Tourist Visa, because afaik I only apply for a Non Immigrant B Visa, after the school apply for the work permit for me)?

I cannot go back to my home country, cause as mentioned I have a job offer from a school in Thailand, and they want me to start asap. Furthermore I have a Thai girlfriend here.

I would be very happy if you could give me an advice what I can do.

So I could leave Thailand in the direction of Laos for ex and come back with a tourist visa? Will they give me a Visa on arrival, or should I go to a Thai embassy or consulate to obtain a "real" tourist Visa.

They will not blacklist me?

I just realized that I forgot to mention that my Thai GF was calling to the Immigration Nakhon Sawan, and the officer told her, that due to the new overstay rules my only option would be to go back to my origin country (Germany).

The new rules are not in effect yet, and in any case these would not require you to go your home country.

You should get a tourist visa, not visa exempt, because that will give you more time to handle the job offer. You can go to Savannakhet, Laos for a double entry tourist visa issued the same day.

Uff, thank you very much. This takes a heavy burden from my shoulders. So if I go to an Immigration with the 20k THB ready, I dont have to be afraid that they will ban me, right? Do I have to show them a confirmed bus ticket or sth to prove them that I will really leave the country?

Actually my plan is to go to Laos or Cambodia on Monday in order to pay the fine and to obtain a new Visa.

You don't go to immigration, where you could be arrested if they they wanted.

You pay the fine at the border or airport, where there is an office always open for purpose.

I recommend you don't go to Phnom Pehn also because the consulate will be closed all next week.

Again, I do not recommend to go get a visa in Cambodia.

Then I think I would go to Laos, Savannaketh. On my own maybe. Could you give me an advice how to go there? Currently I am living in Kamphaeng Phet.

Can I do this as well at the office that you mentioned? Or will there be any problem?

You can not have the stamps immediately copied, also because you don't have the old passport.

They will have to find you last entry details in the database so it would be better if you can tell your old passport number and entry date.

If they can't do that at the border they will send you at the immigration office in town.

After all this talk, I would have expected to see the normal warning and advice of not going to the land border as things are, or can be, made a little more difficult at land borders, especially as you don't have any stamps in your new passprt. I would buy an airline ticket, go to the airport and get the overstay sorted out there. It will far safer and an easier way than traveling by car/bus/whatever other mode of transport and going to a land border. It doesn't have to cost you any more to fly out than it would to go to a land border as there are some rediculously cheap packages now but things will be easier at the airport. Good luck,

i did that on 4 yearoverstay recently, police only interested in doing report. they actually sent me from bkk immigration to police station to get the report and as long as you have a ticket out immigration will not arrest you. re banning as said above not in place yet but there is a 6ft placard at bkk immigration with all the details of the bans, why now i dont know

My family member's receipt for paying the overstay fine says on the receipt that the max charged is 5000 baht after growing at 500 baht per day.

The immigration website also shows a fine for failure to report, which appears to be seperate from the overstay 5000, but my family member was not charged that (last week).

The max fine for an overstay is 20,000 baht.

The 5000 baht is the max fine for not doing 90 day reports or doing them late. The normal fine is 2000 baht.

Only if caught on overstay is a person sent to detention.

A embassy can do little or nothing for a person.

Easiest way is:

Bus from Kampheng Phet to Phitsanulok and then take the bus to Mukdahan. I'm not sure if there is an overnight bus but I think there is one. Otherwise you could go via Bangkok but its more expensive and take longer time.

Remember to get US dollars for the visa to Laos as its about half price compared with to pay with Thai Baht.

If you have a contract and the school can provider you with needed documents then you should apply for a NON-B and then extend it at immigration in Nakorn Sawan when you got your work permit.

A contract is not enough. For a non-imm 'B' visa, need to have a letter of approval from labour department.

For teaching a work permit approval letter is not needed to get a non-b visa unless teaching at a university.

embassy can do nothing

Depending on the embassy, they could help if you want to return to your home country. You could go thru an expedited court process where the 20,000 baht fine could be reduced if you show you have a ticket for a flight to your home country and are prepared to leave immediately.

Since that's not the case for the OP, there's really no point in going to his country's embassy and turning himself in to get a reduction in the 20,000 baht overstay from a Thai judge.

You won't get a work permit in this passport with 10 mo th overstay you name is marked ... try it and you will see

Is it wise to try and clear an overstay at a Land Border Crossing?

Far easier to exit via the airport?

It doesn't make a difference. In OP case it's even better via land because they may send him to the town office as he doesn't have the passport with which has entered. In places like Mukdahan that is not difficult unlike in Bangkok where one would loose his flight.

My advice is go to the airport and fly out after paying. Have an immigration mate at Chong Jom and chances are you may be detained. Get good advice as to what border crossing you use so you do not have this problem.

Sorry just see last post. So maybe border is ok but make sure is the correct one. Not all are the same.
