What visa will my child need, if any, if i marry my Thai boyfriend.

I lived in Thailand but moved back to South Africa 7months ago to have my baby here. My Thai boyfriend is coming over in April, if we get married in South Africa and I move back to Thailand, will my son need a visa or does he get Thai citizenship? My boyfriend is not registered as my sons father though.

You need to get your child's father's parenthood sorted out. Then register you child's birth at the Thai embassy to get a Thai birth certificate. Then he could get a Thai passport.

If not he would need to travel on a South African passport and get a visa for here, He could then get a one year extension at immigration with proof of his Thai nationality.

Your child has Thai nationality, but what you need to do is to register the birth of the child with the Thai embassy in your country. (other wise the Thai government doesn't know Thai citizen was born). You will need some docments from the father for that, to estavblbish that the father is Thai and the child thus has Thai nationality. At the same time you can apply together for a Thai passport and the child will than of course not need a visa.

You should still register his birth at the embassy. That will make it easier to get the one year extension and if things change he could then get the Thai passport.

You check the law against him having dual nationalities. Many countries allow if from birth.

Once you get married you can get a non-o based upon marriage and your son as your child.

If you get married in South Africa you will need to register your marriage here is you want to get an extension of stay based upon marriage.

But your son is Thai by birth, and that makes that he is not prohibited.

Note that nobody is "half and half". He is both Thai and South African.

Thank you both. I thought about that right after i posted, so he can have both passprts then. I will register his father when he comes over then, seems like the best way to go.

This isn't correct. There is nothing in South African Law that forbids South African citizens to acquire or hold a second nationality. I know quite a few South Africans who hold British, German etc passports in addition to their South African one. I would suggest you check this with your Home Office.

Note that doesn't apply to you son, because he is under 18. Furthermore he would not be "acquiring" another citizenship, he's born with it.

It's common that even for countries that do not allow dual citizenship, special provision are there for those born with it.
