Baby Gammy case: Thai surrogate mother applies for baby boy with Down syndrome to become Australian citizen

The baby boy with Down syndrome at the centre of a surrogacy scandal in Thailand is in the process of becoming an Australian citizen.

Gammy's Thai surrogate mother, Pattaramon Chanbua, has lodged papers at the Australian embassy in Bangkok and said she hoped it would give more certainty to his future and that he could be entitled to Australian welfare. The application could be approved within weeks.

Thailand's military-appointed Cabinet this week approved new laws to ban commercial surrogacy.

While money donated to charity had allowed Gammy's surrogate family to rise out of poverty and find a new home with multiple rooms, Ms Chanbua said the citizenship application was an extra safeguard if something happened to her or her family and they could no longer care for Gammy.

She (Pattaramon Chanbua) also hoped he could be entitled to Australian welfare benefits.

or is it a case of she hopes she can become eligible for aussie welfare benefits as the "mother", she has already scored a new house for her and her family why not keep going till she is covered for life.

sad case indeed.baby yes-mother no...

but what do i know about poverty/circumstances to be urged to make the decision to become a surrogate mother...

not always greed is the reason behind it...

The mum isnt entitled to welfare before all the cynics arc up...

The kid however is entitled to australian citizenship and should be a beneficiary of everything that comes with it.

The moratorium was going to happen sooner or later. The trigger would have just been someone else.

I don't know how I feel about this.

On one hand she was clearly a surrogate for easy money, and now will take every advantage available to her and her family.

But on the other hand, she was left with a Down Syndrome baby by scum of Australian couple, so why shouldn't she take advantage.

Difficult one.

Exactly. My wife is a kiwi, who has unrestricted rights to live and work in Australia, but her entitlements to welfare are exacty zero as she is technically not a permanent resident.

Gammy's mum has every right to be sponsored by little Gammy to come and live in australia. Upon receiving the visa she'll have rights to welfare. That much is true.

I suggest the knockers and cynics on this thread look up how long it takes to issue such parent visas.

Current waiting times are around 30 years....

In Gammy's case, he will need to be resident there, but as per other australian citizens he can turn up and have immediate access while there. It's just if he leaves again before 12 weeks centre link will cut off payments. He should have access to medicare, but he'll need to register first. I dare say over the course of his life he might need some medical and other assistance depending on his condition...and as an australian citizen he should have access to that help.

He can only receive welfare if he's in the country or within 13 weeks of departure. Citizenship by decent for the boy, let him have it, my kids got it. Only help he'll get in Thailand is that from the Australian embassy and the right to enter Australia. He won't see any money from welfare and she's got no claim whatsoever.

Just watched the abc news last night which said that the sister had been allowed to stay with the Pedo dad and his wife.

The interview with the mum also clarified things some more. She said IF people who look after him in Thailand like his grandma herself as the mum passed on he'd be able to go to Australia to be looked after there.

Hardly the blood sucking dole bludger that some people want to make her out as...

Our Boys are almost joined at the Hip ... though, if like Baby Gabi and his sister they seperated within a month of their Birth the bonds may not be as strong.

David, i don't think so. Twins are twins wherever they are.

So, sister is with the pedo who cries and cries about his youth and his wife who does not understand a word of English. And the poor wee babby who was left because he is defective.

As the dad said.

Those two children should be reunited and placed in a loving home way way way away from their parents, all three of them.

Patsy ... it's a difficult one all around.

No-one seems to be guilt free ... except the kids of course.

From the child's perspective ... Gammy's sister has an unusual start to her life and her future is a little undetermined as who knows how the media will react in 1, 5, 10 years time with follow-up stories.

Gammy will most likely receive good family support in Thailand and her Family will now lead a relatively comfortable life due to the generosity of the various donations. Government Hospitals will offer little for his ongoing treatment (I presume) and if the Private Hospital system is used, the money will run out one day.

His long term medical treatment most likely will be better in Australia ... but then that raises the question of his parent/s.

Difficult all round.

AR ... you raise an interesting question ... that of the parents collective responsibility with regard to 'maintenance'.

Would it be applicable in the case?

I recall seeing studies that indicate separated twins do not fare as well emotionally as the norm and the time of separation was a minimal factor in it. Anyone who has been close to twins, I have twin sisters, knows that they have an uncanny awareness of each other each other even when separated by distance. Science sometimes provides the statistics but not the reasons.

took my wife 6 weeks for a parent/spouse visa depends on the circumstances if the child needs the mother as our son did. She originally had a 90 day tourist visa and her parent/spouse visa come through during that time. She is now an Aussie.

Not trying to be a pedant that was ultimately a spouse visa.

Look up sponsoring parents, which gammy ultimately would have to do for his mum. Waiting time for these visas is a about 20 or 30 years. Not kidding.
