its most certainly possible maybe not likely, but most certainly possible, one only has to be in country 180 days a year and one is resident for tax purposes, and if one isn't paying income tax at income source then legally speaking if the money is brought into Thailand the same year it is earned then technically speaking you should be paying income tax on this money.

So in essence what "Frits" is saying is actually true and possible in general terms, would the Thai tax man chase this, at this point in time, most likely not, simply because its too hard for any tax they would most likely yield

it is true, ask an accountant. very possible too there are even agreements between countries. if you live in Thailand and get your money from outside, you have to pay tax here and can deduct that from tax paid in your land were your money came from.

appears your talking about reciprocal tax agreements here, with the basic premise that you will not be taxed twice on the same money and it gets quite complicated on jurisdiction and where tax is paid, in some countries income tax needs to be paid at source, and if this is done Thailand would not tax the person again on the same money

OP here. I'm sorry for what a shitshow this thread has become. For what it's worth, I now have enough information to make a decision. Thanks!

At Chaeng Wattana the immigration officers regularly test Ed Visa extension applicants and require you to prove you are actually studying Thai.

These tests are a recent change in policy due to the large number of criminals living in Thailand using ED Visas.

When was the last time you went to Chaeng Wattana for an ED Visa extension?

Now they don't test you. They just give you 2 months instead of 3 and if you want 3 months you pay a bribe, ie double or triple depending if you do it alone or through your school.

And this has nothing to do with fighting imaginary crimes.

This is surreal : The country is ravaged by corruption, billions of public money are lost lost every week to the deep pockets of people in charge. Despite constant economic growth, BTS extensions are not built, education is still a mess, police and justice, social services non existent and you are blaming HIM for not paying taxes lol???

Just to bring you back to reality as it obvious you have no clue about what your talking about Paz.

Actually an honest accountant will ask you how many days a year you are in country, and if it exceeds 180 days a year, you are resident in Thailand for tax purposes, whether you work here or have a company are somewhat irrelevant, as:

1. in the tax codes whether you work in Thailand or not is not differentiated, the criteria relates to number of days a person is in country and whether the money was brought into the country the year it was earned being the key points.

2. We are talking about PIT (personal income tax) not companies or corporate tax

If one is paying tax at source overseas, then one could apply the reciprocate tax agreement , if it existing, which would put you in a position of not having to pay tax in Thailand simply because you have already paid tax on said money

But if is one is running an overseas business/company, not paying income tax anywhere and trying to hide the money away in the like of HK, because there is no income tax because your non-resident in HK and you remit said money into Thailand the same year and are in country for more then 180 days p.a....then legally/technically speaking you are liable for income tax in Thailand.

with the above being said, does the Thai tax man currently chase people in the example above ?...no they don't, could they chase people in future ? yes they could as the laws are already in place to do this and the laws are very specific and very clear in this regard there is no "grey area"

so instead of trolling trying "Frit's" posts all the time maybe you should address/debate the points raised instead..thumbsup.gif

Back on-topic: You can study any language course that you want, as long as the course is approved by the Ministry of Education.

I studied Mandarin Chinese some years back.

But be aware that the immigration department may test your language skills when you come to renew your visa. And I am not talking about your language skills in the language that you are learning.

When I was studying Chinese and went to Phuket Immigration to extend/renew my ED visa, the immigration officer said that he couldn't speak Chinese, so he would test my Thai language skills instead and refuse my visa if I failed that test! cheesy.gif
