Advice on divorcing a Thai wife - getting custody of my 8 year old son

I got divorced from my Thai wife more than a decade ago. We also lived in England. We did not register our marriage in England but it still counted as marriage, so we still had to get divorced through UK courts. We separated and after two years the courts declared divorce through that method.

You didn't have to get divorced in England - you could have divorced in Thailand too.

That's a decision that should be based on cost and convenience though.

Don't think either of them are currently in UK . Also the OP main priority seems his 8 year old son. Your experience of divorce is not relevant.

Definetly get in touch with a ''Thai Lawyer'', and for sure, anything that your wife has been up to behind your back, that you can prove, in any shape or form, keep that noted, as it will be handy for the future, when the Lawyer gets down to the nitty grittys..

Your Wife sleeping with the entire Foot Ball Team has no bearing on whether the Courts will decide if she is a good mother or not. Abandoning the child or failing to look after him/her will. You might get sympathy from the Courts for being unfaithful, and this is grounds for Divorce, but if you have a child in her custody, you will still have to pay Child Support.

If you want this child, your only course of action is to try and make some deal with your wife. If she refuses to give him up, you are pretty well sunk, and stuck with child support payments for 10 more years.

If you do go for a Divorce then Thailand would be easier to do and cheaper. With your property in the UK, and Income, I wouldn't trust them to give you a fair settlement. If you fight htis against your wife's wishes expect this to be expensive and to go on for years, Why bother if you are in nor rush. Just let it ride.

i had to go thru family court to get divorce and sole custody of my daughter,

it was quite easy to prove she had been unfaithful as she was pregnant and had been away from us for a over a year

Lawyer was 50,000, ex had to pay court cost ( never did) and child support ( never saw 1 baht) but who cares, she was out of our lives.

IF ur child is in the uk with u dont let him leave>>>>

u NEED get the sole custody form the court, as without both parents ur son wont be able to renew his passport

Thanks for all your advice , quick question, to sign the divorce documents I believe you need to do it at the provincial office ,is this the case and does it need to be the same one that we originally signed it at ? Thxs

You can get divorced at any district office in Thailand.

Just a thought for you though, what ever you decide to do unless you are absolutely fluent in Thai then even if you don't want to use a lawyer do make sure you employ a proficient interpreter so you know exactly what you are agreeing to.

To get divorse in Thailand and also get 100% customer for your kid is not easy. I have start to do this and it take time and money.

First i use Siam Legal in Pattaya, but they cheat me... if you want know more, please PM me

I later get a attorney from Bangkok. He is very good and if he take your case he will never loose.

You can tell him you get his name from Rune, in Pattaya

Most of the attorney in Pattaya have a agreement, to be agreed before the real court start, then they make more money because to go court it take many days... i expect in my case is will be about 20 days in court
