HI,

I am in Thailand on a third time,90 days exempt entry.

My exempt entry will be ending DECEMBER 3rd,so I was planning to go to Penang by the end of november or beginning of December,since I am in Phuket,for a TOURIST visa.

With all these changes happening these days,I am really concern if I should go there before NOVEMBER 13th,when the new rules are going to take place

I would appreciate very much any advise.

No problem

Penang with provide you with a single entry tourist visa.

But if holding a Brazilian passport you are entitled to a 90 day visa exempt entry.

Is there a reason for wanting the Tourist visa which will only allow a max stay of 90 days.?

Are your three 90 day entries back to back?

There will be no changes to being able to get single entry tourist visa after the 13th.

For what it's worth. I personally can confirm that the Thai consulate in Penang is no longer giving out Double or triple entry tourist visas.

Only single entry (And METV from 13th onwards)

Penang have never issued triple entry visas !

I would be grateful for some constructive advice on the following. Among our group of friends we were talking about the visa changes and the lack of information. One area we discussed was the banning of people who overstay. One of the group (British Citizen) said he had a 9 year overstay. He explained that when he moved here he had separated from his wife and the house which was his was being sold she emptied the joint bank accounts and was trying to sell the house and keep all of the proceeds for herself. He was lucky that he had arranged to have his pension paid directly to a Thai bank so he had enough to live on not extravagantly but not enough to get a retirement visa or travel to get a long term visa. We talked about the new rules for overstaying about being banned from Thailand but do not know if it is in force yet or is it still to be decided. The legal process is now over in his favour and he will be receiving his funds soon so will be able to apply for a retirement visa. We advised him to travel out by plane as quickly as possible and we would help him financially to pay the 20,000 Baht fine at the airport. Can anyone please advise if the new ruling is in place and if he pays his fine and flies out on a return ticket will he be allowed back in and given a 30 day visa upon arrival? Sorry it’s a long message but I wanted to give you all the information. Many thanks in advance for your help.

I have seen nothing to confirm the new overstay rules are in effect.

He should go out as soon as possible to Vientiane or Penang and get a single entry non-o visa if he has the financial proof to apply for an extension of stay based upon retirement. If money in the bank ti only has to be in the bank on the date of application not 60 days.

Thank you for your reply his funds will be transferred within a month so at the moment we advised him to get a return flight to Singapore then get a 30 day visa upon re-entry by then his funds should have arrived. He can then apply for the retirement visa.

You are providing bad advise.

Your friend

1 Cannot apply for a "retirement visa" because there is no such thing.

2 If your friend wants an "extension of stay based on retirement" he will first have to obtain an "O" visa

Please, if you do not know then do not offer "advice".

I always come in on a 4 month air ticket and in later years a 2 month visa. The double entry no go anymore. Ten days ago I applied to the Embassy in Paris. Had it returned, I can no longer enter with a four month ticket, it must be a 90 days. Also the Consulate in Lyon no longer do visas by mail. It must be in person..

We understand about that we just call them a retirement visa as we all have them the advice was about going to Singapore and paying the overstay then getting a 30 day visa and then deal with the retirement issue when his funds arrive. But many thanks for taking the time to read and reply

Huh?

Ubonjoe I don't want to get a retirement visa. Will I qualify for a METV if I am not employed.

I want to stay with friends part and not book hotels can I get a METV?

No,my 90 days entry were not back to back.In between I have been in Bali for a month,came back to Thailand for a month,went to Europe for 2 months,back to Thailand.in september 7th.But,this last time,the immigration officer told me,he was going to put a mark in my file,that I could not enter again on a exempt entry,that I need to get a visa.So I am going to Penang,just a few days before my entry expires.

Do you think is going to be OK ?

Yes,I was told ,by the immigration officer,at Phuket airport,during my last 90 days entry,that he was going to put a mark in my file,that i need a visa and will not be allowed to enter Thailand on a new 90 days exempt entry.

So I am going to Penang for the visa.I strongly hope that this will work because I do not want to leave Thailand in the next 6 months..

To the Brazilian gentleman

As you need to apply for a visa and don't seem to be able to get another 90 day visa exempt entry with a Brazilian passport (based on what you were told the last time you entered Thailand).

The tourist visa is for 60 days only and you can extend for a further 30 days at immigration offered in phuket.

You cannot get a 6 month visa as you will need to return to Brazil to apply for one of these, not Penang.

If you wish to stay 6 months you will need to exit Thailand at 90 days and apply for a new tourist visa.

Be aware that the requirements for a tourist visa include proof of outbound flight, funds for travelling, accommodation etc. Some consulates and embassies do not ask, others do. Last week in Penang a neighbours friend was asked to provide all of this, in the same week another guest at his penang hotel was not asked for all of this. Just be aware that a tourist visa does require more than a fee to be paid. You've not had to worry about this before but should read up about the requirements in case you are asked to provide them.

Could they be different?

I am hoping I can get it w/o having a job and maybe with staying with friends in LOS. I hope they don't force me to get a retirement visa.

I think there will be some flexibility on the requirements. If you an show the required money in the bank a some form of income I think they would waive the employment requirement.
