I posted this on April. But did not get any clear answer to item 3 and 4. Anyone help please ?





We have just bought an old town house, in the middle of a terrace. The building is set back about 5 meters from the road and according to the land deeds our plot extends out to the road. There are markers are in place on the ground. This is all fine.



Questions?



1. How close to the property line can the adjacent owner build a wall ?


2. If they exceed the allowable or encroach my land what steps can be taken to redress the issue ?


3 On the roof (flat usable concrete roof) can they build on the party wall without our agreement ? (In our case they have already build the partition wall up from the existing 1 meter to about 2 meters and it is leaning slightly into our side.)


4 If not allowed what steps can be taken to ask them to remove it?

Yes they can. You have to be realistic about the lean. If it is very slight, it's going to be easier to live with it than go through the hassle of getting it remedied. Consider that the owner probably didn't want the wall to lean; instead it's probably just poor workmanship.

Be thankful. Good walls make good neighbours.
