BANGKOK: -- The National Broadcasting and Telecommunications Commission will propose its broadcasting board to revoke the digital TV licences of Thai TV Co after it failed to pay the second instalment of its auction fee yesterday.

Thai TV which was awarded licences to operate two digital channels, Loca and Thai TV, again failed to meet the extended deadline yesterday after failing to pay the second instalment of 288.472 million baht due in May 25 last year.

NBTC secretary general Takorn Tantasith said Thai TV has been given several chances to settle its financial crisis with three notifications sent to it to suspend its broadcasting.

But after the extended deadline yesterday and Thai TV still could not meet the payment, he would propose the broadcasting commission to revoke its licences on February 8.

Besides he would also send notification to Thai TV’s guarantor, Bangkok Bank, to pay the remaining auction fee amounted to 1,634.4 million baht within 30 days on behalf of Thai TV.

Loca and Thai TV channels went off the air early December last year after facing cash flow.

It also filed legal case against the NBTC accusing it of failure to facilitate a smooth transition to digital TV, seeking for 713 million baht in compensation.

Revoke the licence then also demand the guarantor to pay.

Normally ( and I don't know why I use that word), the guarantor would be required to pay the outstanding monies... Then the guarantor would sue the lendee.

Sue or otherwise enter into negotiations to recoup their money, like selling the license to a third party.... As the guarantor becomes the de facto holder of the license.

So... If the television license is revoked, the guarantor would sue the government , as they ( govt) retain both the rights and the money... An obvious conflict

However... Keeping a deposit, and reselling the rights is fair and equatable... But Of course, thats not mentioned as an option... TIT, and they likes it both ways here
