maccat Posted February 22, 2016 Posted February 22, 2016 Hi I have been living back in the UK for some time and my wife, who is in Thailand, has just informed me that she wants a divorce. We both agree this is for the best and it will not be contested in anyway. The car and land we bought will obviously become her property. My question is can the divorce been done without me returning to Thailand? As much as me and my wife have no issues there are brothers and cousins who may cause a problem or two if we met. Any information appreciated.

harrry Posted February 23, 2016 Posted February 23, 2016 If she and you are both in agreement about all issues it would probably be quickest and easiest if you both return to Thailand. A few days to get the documents they need validated and then a morning at the local registry office. In the UK you or she will have to stay for a couple of years and the outcome for assets may not be to your wishes. I presume you married in thailand which will make this easier.

He figured she got all the stuff so she could pay for the lawyer........ This is what I am hoping for. We both realise things are not working out and it's best to move on. She'll keep what we had bought during the marriage. She has stayed in Thailand and I am back home. Really don't want to fly over just for the sake of signing a couple of forms if this can be done by her.

Really don't want to fly over just for the sake of signing a couple of forms if this can be done by her. there will be a delay of at least a few yeasr before she can file for divorce in the court here. here as apparently the only grounds you have are seperation. A 3 year period of separation * One spouse has deserted the other for over one year * The husband has taken another woman as his wife * The wife has committed adultery * One spouse is guilty of misconduct (criminal or otherwise) * One spouse has been imprisoned for more than one year * One spouse has physically or mentally harmed the other * Lack of marital support * One spouse has had incurable insanity for at least 3 years * One spouse has broken the bond of good behavior * One spouse has an incurable communicable disease * One spouse has a physical disability so as to be unable to cohabitate as husband and If you both agree and are present though you can get a divorce instantly in a thai registry office. Be warned though that sometimes the UK will not recognise this as a valid divorce as it is not through action of the court. I suggest getting legal advice if you do that. Flying back for a few days would be the quickest and cheapest way of doing this if they will recognise an administrative divorce.

However each of them have a delay of some years generally 2 Also there is a need for a lawyer to file the case in the court. Lawyers fees will most likely be in excess of 20000 baht. You can fly here and do it tomorrow for about the same for the plane fare and the divorce at the ampur is free.
