My american fiance couldn't go to visa run, then his school agency said they finally not going to do his work permit and he's short on money now, so we decided he will pay 20K when leaving Thailand in mid of March when contract ends. But we want to be together so we need to get married before he leaves.

Anyone knows if he can get married on overstay?

Anyone knows if he can somehow clear overstay without leaving Thailand in case they turn me down? Like at immigration?

You appear to be posting as both parties in a pending marriage so a bit confused.

1. Overstay is a serious issue and starting 20 March will be grounds to prevent return so best take care of this ASAP.

2. Embassy and District officials could become aware of overstay and this could cause immediate arrest and jail/deportation (worst case but it can happen). Low key is key - getting married is not low key.

3. Overstay can only be cleared by departing Thailand. There is nothing to prevent a return to then marry.

4. Other post makes it appear you have no home country address/references which would make this even less low key.

Then if he is lucky and does not get arrested he must go to the Amphur to get married, again a slight chance he could be arrested.

If he does not clear his overstay before March 20, he could be banned from returning to Thailand for a year or more, how is that going to affect your marriage?

Overstay can only be cleared at a border or airport when leaving Thailand.

We got affirmation, and we got MFA approval, nobody got arrested. We don't worry about ban, we plan to leave around March 15. We will try probably to go to amphur first and in worse case scenario make short visa run and overstay clearance, then go to amphur again just hard to get day off from work and very expensive penalty for day off.

Also a copy of passport and arrival card must be produced.

Just leave and pay overstay before new rules begin, that's the main thing, then come back on tourist visa and take it from there I guess

You will need to fly out and clear your overstay at the airport before March 20. Overstay are not cleared generaly at land crossing.

Because I want to know what will happen at Amphur when we will get there, maybe some people had similar experience, thats why.

Because I want to know what will happen at Amphur when we will get there, maybe some people had similar experience, thats why.

When you arrive at the Amphur they will ask for a copy of the arrival card. If you can't show one or if it's out of date what will happen after that will depend on the Amphur. It will be anything from go away and get one to worst case calling someone senior who may call the police.

As many people in Thailand say' 'up to you'..

Do a honeymoon weekend in Penang very romantic place...cheap too

Then you can Sort out The overstay ..out and in just a couple days....

Done deal...

Then nine months from now ...

you might hear the pitter patter of little feet and it will make the trip soooo special worth 20K baht for sure..

Highly doubt you will find anyone who has married on overstay as it would not provide the path to going to USA unless the other already had passport allowing entry - in most cases here marriage is to a Thai so there would then be immigrant visa processing of many months before travel could be made.

MFA approval is a must regardless of citizenship. We plan to get marry in Thailand because we want to send USA immigration petition asap. The imm process is long and painful. If we dont start it now we must wait 6 months to get married in States. One of us must stay in Thailand until June. And it's cheaper and simplier to get married here. The only mistake was made: stupid overstay. It is very common for two foreigners to get married in Thailand.

MFA approval is a must regardless of citizenship. We plan to get marry in Thailand because we want to send USA immigration petition asap. The imm process is long and painful. The only mistake was made: stupid overstay. It is very common for two foreigners to get married in Thailand.

In any case sort the overstay before you go near any office or official in Thailand. Do it quickly as the party on overstay now is at risk of being arrested, detained and possibly deported. Get to an airport and fly to Malaysia, you will need to spend two nights there, one day to apply and another to pick up the passport and return. Don't go near an Immigration office, some may advise that but believe me it's a bad idea.,

If you have ever seen the inside of IDC then you would understand.

Thanks for advice, why wouldn't they let to pay 20K penalty at border by crossing by land (before March 20 of course), get stamp, get married in Thailand and move to States for good?

You kidding me. If I ask such question at Amphur directly, they will obviously refuse to register our marriage. Anyway as I read from experiences of others, the Amphur ask for visa pages but often don't look at visas too much. So we will do attempt Number 1 and show up at Amphur with all our docs first, as it is, and we will see.

You kidding me. If I ask such question at Amphur directly, they will obviously refuse to register our marriage. Anyway as I read from experiences of others, the Amphur ask for visa pages but often don't look at visas too much. Attempting fraudulent misrepresentation of fact does not seem to be the best of ways to start married life.

When I got married the paperwork (including my visa/extension) were examined closely.as was the paperwork supplied by my now wife.
