Details.

I am handing over my shares to my business partner.

I have a Non O Extension to stay and a work permit.

I re-entered the Kingdom on 18th March.

Must I leave as soon as I hand over my shares? What do i do with my work permit? When I leave is there anything else I need to do?

  • The handing over of shares has no affect to your permission to stay.

Your permission to stay (extension) becomes invalid once the work permit is cancelled. At this point you need to leave the country or arrange for an alternative extension of stay.

If you leave the country by air and without a re-entry permit, your extension of stay will end.

If you leave by land you might need, at some borders, to show confirmation of your employment ending.

Isnt handing over my shares effectively nullifying my employment? Ie no longer working as the boss.

When do i have to hand in my Work Permit? My visa is valid until June 13th but I still have 59 days until my 90 day report.

If you are required to make 90 day reports you do not have a visa but you might have an extension of stay(which is not a visa! )

It might assist if you were to look in the passport and determine exactly what you have.

Your extension (it is not a visa) ends as soon as you are no longer working. If are still involved in the company operations you would still be considered to be working.

Your 90 day reporting has nothing to do with having a job or your work permit.

Is it possible to get a non-B multiple entry based on OP's situation prior to handing over the shares or whatever other criteria disqualifies him? From Penang?

Possibly but he would need a work permit valid for 8 months to get it.

Again, your work permit is not connected to your ownership of shares. A foreigner can be employed by a company and have a work permit without owning any shares of the company.

However, once your employment ends, your work permit must be cancelled and with this, the validity of your extension of stay for the reason of employment ends.

If your business partner agrees, after you transfer the shares to him you can continue as an employee of the company in a different capacity, with a new job title and a new job description, even without salary, for example as a consultant, until your current permission to stay expires. There is probably a form to be submitted to the Department of Employment for this change.

I have a Non B extension to stay.

My apologies. I had accidentally written Non O at the start and stupidly written Visa after.

Actually it would be an extension of stay based on _____, most likely "employment." The non B has not been extended.

Thank you everyone. If I may ask also unless you should like a separate post. My Work Permit expires before the renewal of my Non B extension of stay. What are the complications of this? Can i stay after the Work Permit date expires and until the end of my Non B extension of stay? Must I leave as soon as the Work Permit expires?

The extension is invalid without a WP.

You can apply for a 7 day extension during which you must leave the country.

You must hand your work permit in to immigration I think within 7 or 14 days, your non-b visa must be officially cancelled at the same time, you get a 7 day extension where you must activate your new visa, if you don't cancel your non-b you will end up on overstay, this happened to me.

  • Your permission to stay is linked to your work permit so as soon as the work permit is cancelled or expires your extension of stay becomes invalid and you should leave or arrange a new extension.

Immigration has nothing to do with issuing or canceling work permits. That is done by the Labor Ministry.

In order to get the 7 days you have to apply for them pay 1900 baht
