I am in the final 90 day permission to stay on a non-O visa based on marriage to a Thai citizen. The permission to stay expires on 23rd May. As a UK passport holder, my plan was to visit Laos and get a 30 permission to stay, at the end of which I intended to to go to Savannakhet to get a new 12 month multi-entry Non-O visa during the later part of the currency of which the wife and I intended to return to the UK for an extended stay.

The time scale has been brought forward and we now intend to return to the UK at the end of August or early in September of this year. That makes it pointless for me to get a new multi-entry Non-O visa.

My question are these: Can I extend the current permission to stay, and if so, for how long? What documents will I need to produce in addition to form TM7?

You can extend with 60 days as married to Thai national.


From Police order 138/2557


2.24 In the case of visiting a spouse or children who are of Thai nationality:
Each permission shall be granted for no more than 60 days.

1. Application form.
2. Copy of applicant’s passport.
3. Copy of household registration certificate.
4. Copy of national ID card of the person having Thai nationality.
5. Copy of a marriage certificate or copy of a birth certificate.

Your wife will need to be with you when you apply. You will need your marriage certificate plus a copy, copies of your wife's house book registry and ID card. If not living where your wife's house book is for you will need proof of residence.

They would expect the baby to be with you. If their mother was with you that would also help.

Why not make it simple and just get another 12-month visa for 5000 baht? Plans might change in the future. You also don't say how long the extended stay is. Would you return within the year and then need another 12-month visa if you don't get it now?

It is just one of their requirements, Not sure why but suspect they want to be sure you have a relationship with your child.

By extended stay I am mean at least three to five years, probably longer, not months. We would prefer to return sooner and therefore not need any extensions, but the timescale is dictated largely by how long it takes to process the reactivation of my wife's unlimited leave to remain in the UK. Any visits to Thailand in the foreseeable future would only be for a vacation.

It seems that the 60 days to visit wife, followed (if more time is needed) by a border hop for visa exempt entry and another 60-day extension would be a decent option for your situation.
