Hi, can someone please offer the steps I should take in this situation please:

Got my Decree Absolute from the UK and at some point would like to remarry here in Thailand. My ex wife is also Thai, and the marriage was registered at a Amphur in Bangkok. I do not have the marriage certificate and will not be able to get it unfortunately.

What do I need to do with this letter in order for the Amphur to accept my divorce?

What do I then need to do for the British Embassy to issue me an Affirmation of Freedom to Marry? (is it translation then MOFA then Embassy?)

You got married in the UK and then divorced in the UK, and now would like to remarry in Thailand.

  1. Take the Decree absolute and your passport to the British embassy and ask for an Affirmation of Freedom to Marry.
  2. Have the issued Affirmation of Freedom to Marry translated into Thai and have it legalised by MOFA
  3. Go to the Amphur with your wife and register your new marriage.

Thank you Morakot, nice and clear and appears to be without complexity.

The only difference is my previous marriage was registered in Bangkok but divorced in UK (because we eventually moved back there). I'm guessing this won't make any difference to your points above though.

I'm not entirely sure at this point.

I don't think you are still married under Thai law, but you may have to inform the Amphur where you got married that you are now divorced. The legalised copy of the degree absolute (with translation) should be sufficient, but I guess you need your original certificate of marriage registration or at least the numbers.

You may want to contact the Amphur where you got married first and explain the situation.

OK, I checked this in more detail.

From what I understand, you are free to marry and the UK degree absolute of your Thai marriage registration is valid. The UK made divorce can be registered at any Amphur.

I'm in the exact same situation,I went to the Amphur where we married in Bangkok. Still listed as Married here,they advised me to get a certified copy from the British Embassy(which I did)of the Degree Absolute,no mention of translation. Didn't plan to remarry then,you probably won't need that copy,just the right to Marry. The onus is on the Thai person to inform them your divorced,if you remarry,your ex may have a problem with them,but not you or your your new Wife.

I only had an English translation of the wedding certificate,my ex has the Thai version.

If you can meet your ex at the(an?)Amphur,it only takes 10 minutes to divorce,if you both agree. My ex won't meet me,so if I ever remarry(legally),she will have to explain to the Amphur.

That would be sweet to drop her in it,but not good enough to remarry for!. ;-)

And you are correct,translation,then MOFA. I believe there are translators nearby,but not sure. Been a long time .

After you leave the embassy with your affirmation of freedom to marry, the easiest and least stressful way is to go into the translation shop on the second floor of the home pro shopping center opposite the embassy, get them to translate and take to MFA to get stamped and then they will post to your home, all for a very reasonable fee plus postage.

It is possible to divorce (uncontested) at a different Amphur from where the marriage was registered. But this usually requires a legalised copy of the non-Thai person's passport, in addition to all the other documents.
