Non-O (Marriage) - Expiry vs Reporting Date

I have a non-O (M) issued for marriage on June 1, 2015, with an 'Enter Before' date on June 2, 2016.

I did an online 90 day report recently which is valid until July 21, 2016.

I plan to leave the country for a few weeks at the end of June.

Is it already too late to apply for an annual visa extension?

You can apply for s 1 year extension of stay on, or within 30 (maybe 45) days before, the last day of your current permission to stay. That is the 'admitted until' date stamped in your passport.

Wow that comes as a shock - so I've been going through the motions for the past year for no reason? I'd have thought one of the officials would have picked up on that, or at least that the online reporting site would throw up a complaint? :o

I'm not disputing your knowledge, but where could I find some documentation explaining the difference between the 90 day and the M visa in this regard?

You only need to report if staying longer than 90 days. Your visa only allows you to stay for a maximum of 90 days, therefore, a report is never required as you leave the country before it's due.

But I haven't left since October last year, and my entry stamp is valid until August this year - confused!

Post a picture of your visa and blank out any personal details.

That will clarify the situation instantly.

I did my first 90 day report at Lad Prao in January, and there was no mention of overstay, just the paper telling me to report again in 90 days, which I did online in April, and was issued a receipt valid (as stated in the OP) until July.

As I said earlier, the stamp on my departure card (acquired in October 2015) says "admitted until 31 Aug 2016"

Ok so from your picture you have a multi entry non immigrant O visa which has now expired and you are on overstay if you say you haven't left Thailand since October.

Unless of course you have obtained a one year extension of stay by meeting the financial requirements.

Sorry to be the bearer of bad news if you haven't done the extension your currently on overstay irrespective of the admitted until stamp of August 31.

As I keep saying, I have an entry stamp from October which says "Admitted until Aug 31 2016".

I also have receipts from 2 90 day reports, the latest of which says that my next report is on July 21.

Something doesn't add up...

  • Although the IO made the mistake it is your responsibility to check you were given the correct permission to stay. Whether immigration will 'let you off' will depend on the person you deal with.

Get yourself down to immigration tomorrow and rectify the situation.

1. on the visa and

2. on the last arrival stamp in your passport, ie the stamp placed on a page of you passport, nor the departure card.

Complete answers to both questions are required.

1. on the visa and

1. I can only assume you are referring to the photo I posted above - it says 'O' under category

Just spoke with the wife, who remembers the immigration official at Cheang Watanna saying to us that I needed to return there every 90 days. This is when we were returning to collect all the paperwork after the first application for extension of stay.

So all 3 immigration officials got it wrong?

I see that you went to the immigration office to collect "the paperwork after the first application for extension of stay"

  1. Did you subsequently submit the application for extension?
  2. Was your application approved? if yes, until what date was your permission to stay extented?

And please stop talking about the date on the departure card. It is the dates in your passport that are important here.

  • You need to report if you have any permission to stay longer than 90 days. e.g. A non ''O-A' visa entry or a 1 year extension of stay.
  • Entry stamp mistakes happen often.
  • 90 day reporting doesnt have anything to do with your permission to stay so it's feasible that the error wasn't picked up.

OK, your arrival date and your "by by way" regarding your extension of stay has cleared up the puzzle. No mistakes were made by immigration.

Do you have a stamp in your passport from CW saying Extension of Stay?

1. yes, my comment above was about instructions received from the official when receiving the extension after submission

2. extension was granted on 23 SEP 2015, with a "stay permitted up to" of 31 AUG 2016

You only had to say you had an extension of stay about an hour ago.

So let's start again...

1 - If I now exit the country after my visa "Enter Before" date has passed, will I need to get a new visa before I return?

2 - What happens when the extension of stay passes? Can I get a further extension without a new visa?
