visa overstays

just realised my setv extension runs out today and do not have time to get to nong khai before the border closes to get another. if i travel up on my motorbike from chonburi to nong khai with a 1 day overstay tomorrow am i likely to face problems if stopped at a checkpoint?

You could make a quick to trip to the Cambodian border today to get a visa exempt entry unless you have several recent ones. You would get 30 days if you are from a G7 country or 15 days if not. You could then get a 30 day extension of the entry,

If you plan on getting another tourist visa in Vientiane you may not have enough time left this week to do it unless you can be at the embassy by 11:30 tomorrow.

You could also apply for a 7 day extension. pay 1900 baht and be given 7 days to leave the country.

i already have the 7 day addittional extension and being british i would only get 15 days at cambodia, Why 11.30am tomorrow, what about crossing the border tomorrow and getting there first thing friday?

Yeah of course forget about that. so if my understanding is correct i can get a 30 day visa exempt in cambodia, return same day and then extend for 30 days? Thanks for the information by the way. Will still have to risk travelling there tomorrow with a 1 day overstay and fine

Technically possible but highly unlikely. If you are at the border they will let you exit as long as you pay the overstay fine.

IMO doing an out/in visa exempt with an overstay is not a good idea at the Thai/Cambodian borders. They are far more unpredictable and inconsistent when it comes to out/in visa exempt entry than the Laos borders. I would go to Nong Khai so that if you have a problem re-entering using visa exempt entry you can go to Vientiane for a visa.

yeah but what if iam stopped at a checkpoint along the way?

based on your advice though its not worth me going to laos and getting a visa until Monday am but that means travelling with a 4 day overstay through checkpoints en route, sounds risky? no problem paying for overstay but i do not want to be apprehended

It is theoretically possible you could be arrested at a checkpoint with the one-day overstay (unlikely, but possible). If you are, it will probably be because they are fishing for a bribe.

 

You really are playing with fire, though. It would be much smarter to jump on a bus to the Cambodian border immediately. They are open until 8:00 pm today.

As a small update for all i have just been to Chonburi immigration and been advised that i will have no issues traveling through checkpoints with only a one day overstay as a 24hr leaniency period is allowed. only question is now do i go to cambodia or laos, based on advice above i beieve these are my options 1) i would only get 15 days with a visa exempt at cambodia (if i got one at all) but could re-enter same day, 2) would get 30 day visa exempt at Laos and could re enter same day 3) SETV at Loas i would have to stay there the entire weekend. Have i got this correct?

All this 'Unlikely to get arrested' I find pretty strange advice considering the law now plainly states that if your stopped on a short overstay, it involves arrest and a years ban from entering Thailand!

Personally, I consider riding a motorbike through a check Point particularly with the referendum security being put in place, really is the last thing to be doing.

A cab to the airport today, pay the one day overstay and fly out even if it means a weekends stop over to get it sorted would be what I would be doing.

Immigration have just confirmed it to me regarding only 24hrs only

You will get a 30 day entry at the any border crossing since you are from the UK under the G7 country rule.

If you go to the Ban Pakard crossing (nearest to Pattaya) you will likely not have a problem getting an entry. If you were going to Poi Pet then I would say it could be a problem.

Good luck Kurt. I hope they are good to there word because it's a problem when you make a genuine mistake with no attempt to deliberately over stay.

checking other forum posts its saying i cannot get a visa exempt anywhere, these are from 2015?

Those were likely from September or October last year. It is back to normal now.

You will get an entry when you do the crossing.

The main risk of getting caught with a 1 day overstay would be opening yourself up to a bribe. I am pretty sure the police/immigration and courts would not want the hassle and expense of putting someone through the legal system for a 1 day overstay especially if they were on the way to a border.

The overstay fine is waived at the major airports if it's 1 day.

Let's hope so. As I said, if there if there is no intention to over stay and your on the way to sort it out, then for one day, you shouldn't be penalised. Anybody can make a genuine mistake.

I really am puzzled as to why the OP spent today posting on TV rather than just going to the border. Some people seem to just like living dangerously. He will probably get away with it but, if he encounters problems, he only has himself to blame.

The OP was too ill to travel today, it would be fairer to just ask the question as oppose express your opinions and assumptions without any factual basis for such

Better plan:  Go to Immigration and apply for an extension.  If you do not qualify for an extension, you will still get a new "permission to stay" stamp for 7 days in the future.  The cost is 1900 Baht, and avoids ALL risk of arrest at checkpoints, bans, bribes, and having "overstay" in your passport and in the Immigration database forever.

I suggested that earlier but he is on a 7 day extension now.

Actually the "7 day extension" isn't a proper extension, but an allowance for you to leave the country after your application for a second extension was refused.

 

To say you "just realized" it ended only a week later might seem a stretch if you were stopped with an overstay. Are you sure you got both the 30 day extension and the 7 day allowance to leave the country?

iam very sure, if you see my earlier post where i went to chonburi immigration yesterday while it was still valid and they advised regarding an unnofficial waiver for 24hrs
