Good morning expats,

I got my work permit cancelled on July 6 and book still with me. My passport was damaged and applied for new passport which I got on July 11 and I transferred my non B extension on July 13 by immigration department CW on my new passport. 

I went again on July 21 for 90 days report and I had it successfully. So I'm on overstay or what are the chances of fine if I leave Thailand soon. Immigration will ask me at airport anything or how they will know because I have extension for next 2 months with 90 days report. 

Really stressed :( please guide thanks in advance.

Technically for all intents and purposes you extension of stay ended on the date you stopped working. 

You can leave the country at an airport without a problem. If you plan on returning to the country and have a valid re-entry permit that could create problems when you enter the country.

A 90 day report is not an extension.

What if I return after end of my valid re entry permit that still can create problem at airport ?

If you return after the re-entry permit expires then it would not be a problem.

I am not an expert at all, so I'll be glad to read more.

My 2 cents' worth take on this is that there is no connection -at the level of the immigration officer in an airport- between your (cancelled) WP and your passport. All he sees is a passport with a non-B visa valid until xxx. So until that date I would assume that you are free to leave without overstay.

The only flaw in your reasoning is that the extension of stay based on the work permit ceased to be valid as soon as the work permit was canceled. This may well go unnoticed, but could also potentially lead to serious issues. Note that an entry on a Non B visa remains valid whether you have a work permit or not, but the extension of stay is inextricably linked to it.

What if I leave kingdom soon then at airport they will find I overstayed or I can go without any bad stamp on passport ?

As another poster has already opined, I do not think they can easily tell that your extension is no longer valid. The cancellation of the work permit does not trigger an update to the immigration computer. There would likely only be a problem if, for some reason, a serious investigation was initiated (such as if you had a vendetta with your former employer and they reported you to immigration). If you are of a nervous disposition, get yourself technically legal as soon as possible.

The O/P doesn't have a valid visa. He has an extension of stay.

Wrong advice. The op is on overstay. And yes there will be a problem when it comes time to renew the extension because immigration won't do that without a valid work permit or the letter from the labor department with cancellation of permit. When they see the dates you will be fined.

Wrong quote. I do not deny that he is technically on overstay. I simply said that, in answer to his query, it is unlikely that he will be flagged for overstay when he leaves the country within the date of his current of visa or extension or whatever else is in his passport, since they won't have access to his WP. Renewing his extension was not his question, I think.

Immigration can check upon departure if they don't trust it. I once flew out a day before my extension expired. I had no choice due to work and wasn't in the country long enough to get a new extension or be back within the under consideration period. So I opted to just fly out and get a new non-B visa outside Thailand. When handing over my passport at immigration the officer asked if I was still working in Thailand and asked to see my workpermit. I showed him including the docs I brought with me to apply for a new non-B abroad. Then he stamped me out. I can understand the suspicion when someone departs close to the end of an extension based upon employment. 

Upon return to Thailand I was asked twice to show a workpermit (out of maybe 40 entries). 

 

My my suggestion to to OP is to go out a few weeks before the original extension expiry date and have an unused re entry permit as well. Then don't come back in until after the extension is expired, on an exempt or different visa.
