I would use the thread I started on this topic from a few months ago, but I can no longer find it.

 

I tried to get my Lao wife an O visa from the Thai Embassy in London two weeks ago, so that she can be added to my Extension of Stay (i have already done this for our British son).  They asked to see my work permit, contract of employment and payslips, all of which I had with me.  Then they asked for the Company tax records which I didn't have with me.  Becuase of this, they would only grant my wife a Tourist visa.

 

Will I be able to get her added to my Extension of Stay (at CW) with a Tourist visa?

Since you are on an extension of stay based upon working/teaching she can apply for a change of visa status to get a 90 day non immigrant visa entry.

DOCUMENTS TO BE SUBMITTED IN SUPPORT OF THE APPLICATION FOR VISA OR VISA STATUS ALTERATION (NON-O) TO FULFILL THE DUTY OR RESPONSIBILITY AS AN IMMEDIATE MEMBER OF A FOREIGN FAMILY IN THAILAND.
  1. The application must be submit at least 15 days before visa expiration and, in case of overstaying in Thailand, application could not be submitted.
  2. 1.1 Form TM.86 for the foreigner, who has Tourist and Transit Visa and applies for Visa Status Alteration and applies for non-immigrant visa; or
    1.2 Form TM.87 for the foreigner, who enters into Thailand without visa, but is allowed to stay in Thailand with a permit of stay for a period of 15 day, 30 days, 90 days and applies for non-immigrant visa.
  3. A copy of passport pages (for example, personal information page, last entries stamp, visa sticker and extension stamp (if any) and departure card (Form TM.6))
  4. Either one 4x6 cm photograph or one 2 inch size photograph
  5. Application fee of Baht 2,000.
  6. A copy of passport and a copy of work permit of the person who fulfills the duty or responsibility in Thailand
  7. The Company’s registration certificate, with the details of the company’s business objectives (certified by the Registrar not more than 6 months)
  8. Value Added Tax (VAT) Registration Certificate (Form Paw.Por.20)
  9. List of the Shareholders (Form Bor.Or.Jor.5) (certified by the Registrar not more than 6 months)  
  10. 9.1 A copy of evidence proving that the applicant is father, mother or children or certificate of marriage or birth certificate;* or
    9.2 Letter from a government office, embassy or consulate, certifying that the applicant is a member of the referred family, letter of certification from the Department of Protocol, Ministry of Foreign Affairs*
    * (Documents under 9.1 and 9.2 must be translated into Thai or English and certified by local or overseas Embassy or Consulate of the foreigner and by the Legalization Division, Ministry of  Foreign Affairs of Thailand) (For more information, please call 0-2575-1056-9)
  11. A copy of the list of withholding income tax of Thai employees (Form Paw Ngor Dor.1) (for the past 3 months, together with the attached list of all Thai employees, showing the first to the last names, and the receipt)
  12. A copy of the list of withholding income tax of the foreigner (Form Paw Ngor Dor. 91) for the latest year (If you cannot present it, please submit an explanatory letter.) (Attention: Immigration Commissioner)

Thanks Joe.   Will this have to be done in two stages: 1) Change her visa status from Tourist to Non Imm @ 2,000 baht (before her Tourist visa expires) 2) get her an Extension of Stay based on my Extension @ 1,900 baht?

 

If she extends her Tourist visa by 30 days, it will expire at almost the same time as my Extension is due for renewal (end November).  It would nice to be able to get everything sorted in one go, even if it involves two processes and two fees.

It will have to be done in 2 steps first the visa application and then the extension during the last 45 days of the 90 entry entry the visa will allow.

The visa application requires two trips to immigration about 15 days apart. First the application and then back again to get the visa/entry stamps after the application is approved.

She could apply for the visa at any time during the 60 day entry from her tourist visa up to the last 15 days of it or the 30 day extension.

Your wife would also be able to get a non 'O' visa from the Embassy in Vientiane as an alternative option. I don't know what paperwork Vientiane require, but I think proof of your extension and marriage is/used to be enough. Maybe UJ can confirm.

 

It would definitely be a good idea to get your wife's non 'O' entry sorted out so that you can apply for the two extensions of stay at the same time.

Ideally I want to avoid her having to leave the country as we have a 17-month old son and I have to work, which is why I was keen for her to get a non "O" in London.  I think we will go to CW shortly before her Tourist visa expires in October and try to change the visa, and if we necessary we can get a 30-day extension to the Tourist visa to give us more time to get a new visa.

I have never had any issues getting my Lao wife a Non-O visa that follows mine both when I was working and retired.

She got an O visa in Bangkok? Was this a change in visa as visas are normally only issued outside Thailand? I know getting a visa for Laotians is relatively straightforward in Laos, but we were in London, hence the reference to this in the thread's title.

We've submitted the application to change my (Lao) wife's Tourist visa to an O visa.  Her Tourist visa expires on 16 October.  We had to go back twice as they required a letter from my employer confirming our marriage, and the first two weren't good enough!  They accepted the application on the 2nd visit, due to the imminent expiry of her visa, but we will need to produce an acceptable letter when we collect the visa.

 

My question is, can I collect the visa without my wife being present?  The Immigration Officer said it would be OK, but it would be nice to have separate confirmation in case it's a different Officer.  Obviously I will have her passport, the receipt and all the documentation (should they need to refer to it).  It's due to be collected on Friday.

You can take your wife's passport to get the visa and entry stamps done. 

The office here allows my wife to take my passport to have my extension stamp done after the 30 day wait for approval.
