Phuket court defers hearing on sea gypsy fight for ancestral land

The Phuket Provincial Court has deferred a key hearing in the dispute over land at the Rawai sea gypsy village until April next year.

 

PHUKET: -- The Phuket Provincial Court has deferred hearing a claim to 12 rai of land in the sea gypsy village in Rawai until in April next year in a case that will likely define whether the entire village will have to be relocated from its age-old home on the Rawai beachfront.

 

The court handed down the adjournment yesterday (Sept 5) as Rawai Sea gypsy representative Bancha Hadsaithong accompanied by attorney Pasit Thawornlamlerd appeared in court to answer to a complaint filed by Chindarak Thammajak against villagers for encroachment on land in Moo 2 Rawai, where the sea gypsy village is located.

 

After exiting the courthouse, Mr Bancha said, “I am one of the villagers being sued for encroachment on land that our great grand parents and ancestors have been living for more than 100 years.

Phuket Sea Gypsy sued again in new land dispute case

PHUKET: -- Rawai Sea Gypsies are facing yet another fight over their right to remain in their century-old village, which offers splendid views across the Andaman Sea. 

Rawai local Bancha Hatsaithong is being sued over allegedly encroaching on land owned by Jindarak Thammajak. This latest Sea Gypsy land dispute came to Phuket Provincial Court on Monday for its initial assessment, with the court expected to convene again in April 2017. 

“I am one of many Rawai locals who have been sued over land encroachment,” Mr Bancha said. “We have been living there for over 100 years. My dad is 70 years old, I am 45 years old and we’ve always lived there on the same 100 square wah.”

It's outrageous that the sea gypsies are being driven off their land by developers. Surely the authorities and Phuket administration must stand up in defence of the gypsies. They have every right to live on the land and should not be required to undergo these ridiculous court procedures in order to claim what is rightfully theirs in the first place. Those seeking to profit from the eviction of these gentle people have no social or moral conscience. Thailand cannot call itself a developing country while it allows the rich to prey on the poor.

The Sea Gypsies claim they have been living on the spot for more than 100 years – when was the title deed for the land issued..?

 

It's been mentioned both in this Forum and on land-lawyers sites, that if you don't make use of your land within a certain number of years, you loose the right to the deed – believe it's for some land-titles are 3 years, and for Chanute-title is 10 years – therefore it's often advised to build a fence or wall around the land, and cultivate it now-and-then, to show that it's in use. Some has even mentioned that land squatters can take over land, if they have been living there long enough without being banned...

You'd think 100 years would be long enough to establish residency.

What were the laws 100 years ago? Ordinarily, changes in the law cannot be applied retroactively.
