More importantly, if the police believe the crime took place, and that they have identified a suspect, they have a duty to refer the case to a prosecutor, who decides if there is sufficient evidence to take the case to court.  In Thailand, if the police don't refer the case for prosecution, the alleged victim can bring the case as a private prosecution.

I can understand why a tourist would confuse what's a motosai and what's a tuk-tuk.  

 

Besides, of all the things she's recalling about that night, the number of wheels on the scooter probably isn't pushing to the very top.

 

On the TVF conspiracy side, the initial story says it was a tuk-tuk driver joined by some of his friends.  Perhaps his friends drove scooters?  Or maybe it's just incomplete reporting?

 

That's right, maybe the tuk tuk driver friend met him there on the motorbike.

Many here are claiming this girl was irresponsible - to an extent that could be true, but if she was in such a state were she didn't know what she was doing and two men took advantage of that fact and decided to take her to an isolated location and  basically force themselves upon her - then that is rape, nobody here knows exactly how aware or not she was of what was happening - either way it doesn't matter,   it is especially vile when those that supposedly took advantage of this poor girl were in fact taxi drivers of one sort or another who are duty bound and responsible to ensure she gets to her residence in safely.

That's right. There are hundreds of drivers that take home drunk male and female holiday makers. They go out of their way to help the person. Some of them do not even get paid the fare. They don't stop at some deserted area and commit highly illegal acts. Drunk people are temporarily mentally unfit. Public transporters have a duty to care for them the same as a mentally ill person. It's their Duty and goes with the job. 

Why do the police not take one step at a time.  First get the hospital report to establish if she was possibly raped or not.  It is due today!

Blame the tuk tuk for not having a steering wheel. Move it to an inactive post.

Well that guy on the video didn't rape her i guess, she kissed him on camera. She even warmed her bum on that big wok.

Good point, but headline writers are to blame at The Nation for making the story look like something it wasn't.

Sorry, but "crying rape" can be an excuse for being totally incapable.

That doesn't excuse the man/men involved if she was raped.

If she truly was raped then I have total sympathy for her, trouble is she seems to remember very little. Unless she was given the "date rape drug" which will show up in the hospital tests then I would think this will be difficult to prove even with DNA results.

It seems so far: she was reluctant to report what happened, and has no physical marks that suggest any force was applied, and she admits to being drunk to the point of unconsciousness.

Ultimately she was STUPID, and should never have got into the situation, whatever she was wearing.

I look forward to the trial....

As it turns out, there is now an arrest warrant out for a man. This man was recently released from prison for rape charges. 

Thank goodness this brave young 21 year old came forward quite possibly saving someone's future life. most certainly saving probably many from future rapes. 

People on here blaming this girl should hang their heads in shame right about now.
