Court rejects Dhammakaya’s plea for dismissal of search warrant

 

 

BANGKOK: -- The Criminal Court on Tuesday dismissed Wat Dhammakaya’s petition seeking the revocation of the court’s warrant for officials of the Department of Special Investigation to search the temple to look for Phra Dhammachayo.

 

The court ruled that there was no reason to withdraw the search warrant as requested.

 

The warrant was meant to enable police and DSI officials to search the temple during December 13-16.

 

Meanwhile, the DSI lodged a complaint with the Crime Suppression Division against Mr Ong-art Thamnittha, spokesman of Wat Dhammakaya, and other followers of the temple, accusing them of inciting rebellion in accordance with Section 116 of the Criminal Code.

The DSI should log a complaint against itself and the police for slow leaking the arrest.

Are the legal pleadings online anywhere?   The search warrant, the Temple's petition to revoke the search order, the Criminal Court's decision, ...??

Has anyone seen what specific legal arguments are being used to delay the search?

Most news accounts are at the he-said-she-said level and don't give any idea of the underlying legal issues, if any.

i am surprised the army has not stepped in and sorted this out. would be good brownie points for them. possibly even more than knocking down all the buildings which are going to cost a fair amount to re build.

Followers of this monk have warned there would be dire consequences if the temple is raided. Yet still the wanted man refuses to give himself up, thereby placing his own interests above the lives of others. That needs no further comment.a

I'm split on this topic. A part of me wants to see this guy get his day in court to either prove his innocence or the government prove his guilt while a part of me thinks, why is the government involved in policing religion in the first place?! Fools in my home country give their heard earned money to all kinds of religious institutions and religious leaders and it is perfectly legal as long as the correct tax documents have been filed.....

Perhaps you are not aware that the manager of a credit union (a co-operative lending and saving society) apparently stole many millions (or was it billions) of baht of peoples savings and handed it over over to the (now) fugitive leader of this cult.  Even though the original thief (boss  of the credit union) is now in jail for the theft, the abbot monk and the cult deny that the money is "receipt of stolen property" and refuse to give the money back to the credit union where it was on deposit by its rightful owners.   That is the way I understand it and that makes it pretty cut and dried for me.  They are NOT "policing religion"  as you suggest but are simply trying to recover money stolen in a crime;  money that was given to the temple and should never have been stolen, given or accepted.

Policing religion? Read the full story. They have been breaking the law, not their religion... hmmm?

I've been reading about this scandal ridden temple for years now. The first investigations were done by the Sangha Supreme Council, which I believe can be considered an arm of the government.  The first charges had to do with their fundraising and how it did not fit with Buddhist tradition of fundraising. This I would consider government involvement in religion, however, there have been many charges of wrong doing since then of course including accepting stolen money, accepting improper gifts, transfer of temple land to the abbot and inciting rebellion. No one has actually been brought to trial yet. Not quite sure why the government keeps announcing their plans to arrest the abbot and allowing his followers to block their attempts.

I have some respect for religion people but here with the monks it is a bit shaky since I could tell a short story about my wife father who died last year left his family of seven childrens to become a monk and the mother had to feed them all on her own but the fathe being a monk and were all bow to them make me very uncomfortable even one time he came and visit and the wife said i had to be lower than him.

So this super monk is playing with the junta and the cops and guess what all will be paid good money to let it slide.

it seems pretty obvious that the government could have taken action months ago - something along the lines of allowing any one to enter the grounds of the Wat, but to stop them carrying in any food. Splitting hairs, that would allow the government to take the high road, namely that nobody is being denied their right to enter a Wat. Shut off all avenues for the Wat to bring in food and - in quick time, yuo'd have a lot of hungry disciples. Assuming the DharmaKarma is unable to emulate Jesus and the loafs and fishes, you'd have an empty Wat in no time flat. But there I go again, I'm assuming that they really do have a plan, together with someone in charge who will take the heat.
