Former finance minister Korn insists there is basis to claim tax from Thaksin

Former finance minister Korn Chatikavanich said in his Facebook page on Friday that there was legal basis for the government to demand capital gains tax from the shares deal between Shin Corp and Singapore’s Temasek Holdings.
 

Citing his debate in the parliament in 2011, Korn said he told the parliament then when the Revenue Department ruled then that it could not claim capital gains tax from Panthongtae and Pinthongta Shinawatra, two children of former prime minister Thaksin, then the tax should be demanded from Thaksin himself as he was the one who was directly involved in the deal.

 

That is exactly what Prime Minister Prayut Chan-ocha has been doing now, said Korn, adding that the Democrat government then was about to claim tax from Thaksin but the parliament was dissolved rendering his government unable to pursue the case in court.

PM wants Shin Corp tax issue to be settled in court

Prime Minister Prayut Chan-ocha reaffirmed on Friday that the capital gains tax issue regarding the sale of the Shinawatra family’s stakes in Shin Corp to Singapore’s Temasek Holdings in 2006 should be settled in the court of law.
 

He said he didn’t want to respond to complaints from any members of the Shinawatra family regarding the government’s bid to demand capital gains tax from the family for the share sale deal, maintaining that he did not bully the family.

This is another example of locking the barn door after the horse has escaped

 

The time to do this was when it occured, not this many years later.  For those who wonder why,  it was because the elite realized at the time that if they held the Shinawatra children to a different standard,  then the elite,  would eventually be held to that same standard

 

But the powers to be wanted to keep capital gains non taxable, so it  came back to bite them when  the Shinawatra clan unapologetically used the law as written

The junta's position, and that of those supporting it, might be more believable if they were looking into other share sales, shady SET trading, asset "movements" and capital gains tax collection.

 

But maybe there is just this one single case?

 


FWIW, the PM does seem to be using his unlimited power to "try" this case in the public, rather than in a court of law. In any reasonably "free" country the PM might not be so personally involved in persecuting a case against an avowed enemy? But I doubt anyone can reason with him.

And of course the PTP government were far far too busy illegally issuing and hand delivering passports or scheming how to wangle a whitewash amnesty to bother about such things as pursuing a criminal for tax evasion.

And who controls the courts?? Are the courts on the same page as the PM? The PM and the word Bully perish the thought.

So somebody left PTP in charge of collecting taxes?  Should not somebody from the yellow side keep tabs on this as well ?  UK Parliament and US Senator do not go after their own party members over things like this.   Not sure why you would hold Thailand to a higher standard.

Hello Mr Prime Minister,

The courts will hear the case.

Get your lazy Tax Dept & Finance Ministry to present & submit the charges (how long has it taken?)

The basis of a successful verdict will rest solely with the question

Is the huge amount of monies gained by changing the law the day before shares tradedarrow-10x10.png going to be 

classed as a capital gain or a windfall.

If the law was changed by Thaksin's Government to allow this monetry un earned income then you have a leg to stand on.

Now, get it it out of the" too hard basket"& prepare your sase
